caao of any litigation arising from any
obstruction or alleged obstuiciion lethe
the free navigation of said river , tlio
cause may bo tiiod before the district
court of the United Statoa of any
utato in which any portion of said ob
struction or bridge touches : Provid
ed , that said bndgo shall not bo so
located or constructed as to interfere
with the approaches of the bridgonow
erected at Omaha , on said river , or
with tho'piors of thosamo : Provided ,
however , that thin clause shall not bo
construed to prohibit the crossing of
the approaches to said bridge , if such
crossing shall be found necessary.
SKC. 2 That any bridge built un
der the provisions of this net may , at
the option of the company building
tlio satno , bo built as a draw bridge ,
with pivot or other form of draw , or
with unbroken or continuous spins ,
it ahull not bo of less elevation than
lifty foot above extreme high water
mark , as understood at the point of
location , to the bottom chord of the
bridge , nor shall the spans bo less
than two hundred and lifty feet in
length , and the piers of said brid o
ahull bo parallel with the current of
the river , and the main span shall bo
over the main channel of the river ,

iu length : And provided also , Thai
if any bridge built under this act shall
be constructed as a draw bridge , the

draw-bridge , with a draw over the
main channel of the tivor at an ac
cessible and navigable point , am

make a channel for said river , and to
confine a flow of the wntor to a per

the approval of the secretary of war

any of his species.
