lowed out of the juil except by a written -
ton order from the police judge , and
that nil ordinances concerning the
arrest and disposition of prisoners
shall be strictly adhered to.
. ClIAS. KAUFMIWiK.
It in not too much to any thai the
invi'atigittron was a farce throughout.
There was a disposition on the part of
povoral of the couiicilmen to prevent a
rigid investigation of the charges ,
Mich as the men accused should have
desired R.I much as any one , if not
more , provided they were innocent.
Messrs , Congilon and Baldwin , who
conducted the case on the first day ,
wore excused yesterday , and the case
conducted m a rumbling , tay by all
the councilmen.
Detective Hazon testified ns to the
arrest of Murruy for the burglary of
the lllair depot and his incarceration
in the city jail without ucominituitmt.
Angcll had said ho would not be re
sponsible for him if left there. 1 On hin
return he found that Murray had
escaped and supposed lie had designed
to.
Ollicer Oranacher told the story of
the escape as follows : I took Murr.xy
out to get some watur and ho getaway
away : I was within a fo * yards of him ;
ho wont as if to throw some water out
and jumped over the fence and ran ; I
wan alone and shouted ; this was at1
o'clock p. m. ; it is customary to take
prisoners kept in the hall out to get
water nnd work on tlio street ; when
there are none to gel water I got it
myself ; I take them out on my own
responsibility ; did not know what
Murray was in for ; ho was allowed to
lie in the hall And was not locked up
in a cell.
In regard to taking bail without
authority , Deputy Marshal McOluro
testified : It has been customary for
mo take bail on fines from prisoners
under general instructions from tin
police judgn ; in an arrest for ititoxi
cation I take the amount that would
bo equal to the line and costs , and
the prisoner is sober enough I allow
him to go until morning ; I turn in
the money in the morning ; in the case
of this traveling man referred to , T
him go' with two friends whom
know , * and who promised to take him
to his hotel ; I gavu him back his revolver
volvor and kept , the money for fin <
and costs ; ho had been arrested foi
intoxication and disorderly conduct
the charge preferred was intoxication
The charge of drunkenness prof erre
against McClure was next inquire

into.Dr.
Dr. Rose was put on the stand t
prove this : 13 o testified that his dru
store had been robbed in November ,
heard that part of the goods had boo ;
recovered , wont up to McOluro1
office and found them there ; sevora
policemen were there ; saw o'.man wh
was intoxicated.
Question Was it that man ? ( indi
eating McOluro. )
No , it was that one ; I don't know
his name ( pointing at Oranaohor ) .
lloso continued : I found the good
wet and spoiling ; asked the police t
lot mo clean them , but thby woul
not ; they kept them and put them in
a drawer to rust ; the goods were
worth $10 or $15 ; I did Bay that I
did not care so much for them as
to recover my watch , which was stolen
too.
too.Uoso
Uoso wont on to say that the day
ho catno to the examination of tlio
boys who were arrested , ho found
them discharged ; was told by the
judge that there was nothing in the
case , and that ho had consulted with
the attorney general and had dis
charged them ; it was about election
time , and Hose believed the boys were
turned loose to win votes.
Judge Bonoko stated that ho told
Oflicer Doimhoo to irivoutigato the
case and held the boys till ho could
hold them no longer without a com
plaint from Rose.
McOluro returned to the stand and
testified that the police did all they
couid work up the case and to preserve
oot
serve the goods , but HOBO would ot
avail himself of the opportunity to
clean the goods or to convict the ys
if they were guilty.
Oflicor Doimhoe tostilied regarding
1 the reporting of a police officer whc
. had booiisuapondml for intoxication
- The policeman had been reported
twice.
At thU juncture a councilman made
another inoil'ectual attempt to expel
