It is doubtful whether these classic
surroundings diverted the attention of
many of the crowd who jostled oneli
other on the portico yesterday or to
day , nud will probably continue to
jostle each other for n fortnight to
come. Within the building , on ono
side a jury was sitting out the tosti-
inony in aomo civil action involving ,
perhaps , a few hundred dollars , and
in thu opposite wing is being enacted
the closing net of ono of the most dra
matic passages in American history.
It has been occasionally referred to as
a farce by hasty writer ? , and I doubt
not a largo section of , not tlio majori
ty of the people of the country at
large have somehow cotuo to look upon
the procofading as u pooily played faree
after a terrible tragedy. It has not
impressed mo thnt way.By the kind
ness of .Marshal Henry T found easy
admission nnd n good Beat thia morn
ing , not with any expectation of "mak
ing a report , " that is mostcHectiyuly
done by the rognlais of thu profession ,
but to gather nn such ttiflea as inter
est a new observer.
The court room is larcu , airy , and
would bo ample for the accommoda
tion of all ordinary crowds , but now it
lias been moro than crowded before
the twelve unfortunate men condemn
ed to try the case are conducted into
tlio jury-box , an the criminal whoso
deeds and fate enlist the attention of
two continents , is ItUHtled in from a
room behind the "bench , " and given
his accustomed seat. It is his turn to
testify in his own behalf , and art ho
takes the witness stand on the crowd
ed dais , so close to the jurors that ho
could shako hands with thorn , you
look in vain for anything in his per
son or appearance to distinguish
Charles Guitoau from other men
whom you are meeting in every day
life , on the street , in the counting-
room , in business and professional cir
cles everywhere. You have boon ,
perhaps , in Mead and Tubsaud's
"Chamber of Hoirors , " and carry a
vivid impression of some of the ghast
ly features of the place. The next
time you go there you will probably
find as a now- attraction the counter
feit of the criminal now on the witness
stand , and if so you willseo nothing to
particularly distinguish him from the
other murderers , though a majority of
those known in "State cases" show
moro breadth of brain and linaini-nta
graven by hard thinking.
He poises himself easily for his task ,
and proceeds to give prompt , plain ,
direct , pertinent answers to all ques
tions propounded by his able counsel.
Ho knows the exact situation , but is
not disconcerted. Opera-glasses arc
in lively requisition in the audience.
Ho bears the scrutiny with ea y non
chalance. His answers aroconsistont ,
straightforward , and given always
without the slightest hesitation this
applys only to the direct examination ,
however. Ho is moro cautious when
taken in hand by counsel for the
'Jovernmenr. Judge Porter does not
find it BO dillicult to make him wince ,
us for instance , when ho forces from
him the unwilling , though not very
reluctant confeftiioii that ho lied
yesterday , when ho said ho was
"strictly virtuous" at Onuida.
A wicked observer whispers ,
"
"There , you see ho was sane enough
when ho was there. "
At the end of two hours , havini ;
failed to got in as part of his testi
mony a newHpapur interview that ho
published last Augubt , ho is ag.iin
taken "unwell , " and auks for a receEH ,
to which the opposing counsel do not
object , nnd relief comes to the
strained noiyus and mu.sclus of : i
thousand auditors , moio or less.
Left to gather up the impiensions
fixed by the BCOHO you say the nudi-
enco , composed in about equal num
bers of ladies and gentlemen , the
gentler Hex perhaps predominating ,
with an almost entire absence of the
rougher element , has been as well-bo-
havtd and self-respecting in manner
an any audience you nro accustomed
to meet at the lecture ortho play , En
tire decorum h.w been presented , and
if sometimes a slight ripple of laugh
ter went through the room at aomo
unexpected incongruity or c/l'ort / ut
wit , the thundering cull of "f.ileiico"
from the ofllccr of the court , wliieh
rebuked this mituial ed'ervcsconce ,
seemed hardly nmwary oven to vin
dicate Iho claims of justice to ulno-
lute aubmiRsion in her courts.
.Judgo Cox , who , by the way , was
appointed by President IIuyrH from
the bar of this city , would bo re-
guided IIH a model presiding nflicur in
any court. Tlio illustrated pnpoiH
have given a very fair impression of
his personal appearance , as well ua of
all the more noticeable actors in the
scene. Ho in not ono of those olli-
cious pcmonagcB who nsnuit them-
solvcu on the least occasion , and
rarely inturposts so long as counsel
succeed in conducting this cuso with
out seiiouH interruption or disagree
ment. His rulings uro regarded as

"How would you do it ? "
"Ship him in the mouth , if it could
not bo done any other way ; and it
would not bo any contempt of court ,

Ho added considerable moro , in the
way of invective , which 1 think gave
pretty foieiblo expression to popular

And there is no USD trying to dis-

been , commercially speaking , already
discounted , but ho takes liis meals
punctually and reiterates to the jury

It is not surprising that next to thu
piisoner interest and curiosity center
on his sister , Mis. ticovillo , whose
interest in her worthless vagabond
brother when ho was brought to fnco
the fate of an assassin nccured counsel
for his defense and who now watches
with unflagging concern the progress
of the trial. * She sits with the specta
tors that rim in around the outer cir
cle of tables occupied by members of
the press , in no respect remarkable in
personal appearance save that the
features show unmistakable traces of
some f/reat sorrow or prolonged sudbr-

chooso. Her upparol , modest to absolute -
lute plainness , suggests anything
rather than luxury or afllucnco.
