Tlio city council met in special see- moil Monday mqht. At Iho roll cali all icsponded with Die exception ol > JCnlo 1'hillips and Alderman Unlhank The first question of importance- tlio matter of internal improvement Alderman Churchill thought it was about time work \vas resumed in ear nest. Winter would come before wo had lime to fully prepare. Sir. Cavin , in behalf of his constituents in thu Pirnt ward , called attention to the tin pleasant condition of the sidewalk on franklin nvcnuo. Ho thought n sidc- ivalk should bo constructed nt once so that ho would not bo obliged to walk so far nroutul in going homo. Dawson - son called attention to the sidewalk # rado opposite Gco. Iveclino's , .and said something should'bo done there at once. Mr. Yauglian suggested that all the sidewalks in the city were in n very bad condition , and should 1)0 repaired before the cold snows of winter descended. Ho thought money would bo saved to tlio city if a man was kept at work for the next month traveling about the streets and driv ing homo the loose nails and repairing the broken planks. Mr. Vnuglmn thought that several men and teams nhould bo put to work in cnch ward immediately until Uio streets wcro all in n safe and proper condition. Some one suggested that the work bo lot by contract. Mr. Fonda said that so * far as ho was concerned ho wns nick < if the contract business. Ho believed that the city was swindled out of thousands of dollars by letting this work to contract. IIo believed that tlo | matter should bo placed wholly in the hands of the street supervisor for him to hire what irion and teams. ! Mr. Spclmen moved that ten teams : and twenty men bo hired immediately and put to work in each ward. Mar tin Harden said that they did not need BO many teams. Mr. Keller inoyod that the street supervisor do immediately all the repairing and filling of streets needed , with author ity to hire what men ho wanted , all filling to bo done by the load. Mr. Vnughnn said that the streets in certain locations wcro in a ridiculous shape. They had boon promising todo something until the people wore get ting sick of that kind of taffy. Mr. Churchill claimed that the only proper way to do tlio filling was by the load and having the supervisor there to sco that the city was not cheated. Mart. Harden said ho had become so used to it ho could toll whether a man was Jionest by looking at him and then at the dump-boards. A ics- elution was passed ordering the su- pcrvisor to commence at once repay ly. ing the stroel and filling where need ed , with full authority to hire what men ho thought was needed , and that the filling bb done by the load. Mr. ICelloy introduced a , resolution that the atrect supervisor be instructed to clonr all obstructions out of what is known aa Potlibono ditch , and also that all privies bo removed that pro ject over the banks of the roaring .Lousey , if such u thing could bo done. Uuforo the grand removal began bq wanted the opinion of the city attor ney. Mr. Holmes said that the privy question war one of great importance. Ho had noi explored Induii crock to its source , but BO tar as ho had been A able , to learn the stream was not navi gable. This being the case riparian of owners would have a , right to control this stream to the center. a and if they saw lit to abut their privies against each otlinr from either side lie bo could not BOO what right this city would have to say nay. When the city allowed the Ogden and Pacific Houses to enter that stream wMi their sewerage , they made us liable to .tho or raparian ownois along its banks for for damages. Mr. Fondnfuu'dthntButtlasit. Mr. Yaughiw remarked this should be reported forthwith to Col. Chapman. Ho said that something must ho done especially in the vicinity of Kit-lit of fitrcet. Mr. Jacobs and some fifty others had petitioned the council to dlo xomovo the dead animals that had congregated in that vicinity. Mr. loiida said that while the commiltoo wore in search of partly decomposed bodies ho wished they vould extend their researches into the Fourth wark on on account of that awful creek it took n stomach lined with n tough membranous uubstanco to hold a good Htippor after passing over this of stream of filth. Mr , Keller thorn-lit that the uncivilized people who in habit the banks of Indian crcuk wore inoro responsible for its condition than any ono else. They empty all their field manure , dead hogs , drown of all their kittens , dump all their old oyster cane , and then complain of the if creek because it doesn't smell nweet , 20 Mr. Churchill thought . 'tho muimgo u .t of this creek u big thing to him. dlo. The city , in attempting to con trol it , had got Bbveral lawsuits on Land , and BO far iw ho know , had been beaten every IJnio , Ho did not bo- lioyu in tipping over another man'n outhouses ' . ' 'I less the city had the to jight to do BO. Mr , Keller's motion to clean the Pottibono ditch , and to remove all carcasses that wcro not too fariouo from Indian croc k , was finally earned.JMayor Ynughau called tit- tcntion of council to lljp importance of taking some action on the lovco , Our driving park would bo ruined next spring if wo should have another winter like the ono preceding the last higlMvaler. Ho said a dyke three- quarters of n milo in length could bo easily constructed , which would pro tect the driving park. Help would soon , * bo plenty and . . . cheaper. . . The city shorn not wait depending upon the railroad to help us. .Something should bo done on Union nvomio while labor is cheap this fall. IIo wanted to know what had been done with ( lie powder homo on the street leading lo the driving park. Mr. 1Cellcr reported that all the jrowder was removed and ho had received no li co from Mr. Miller that the city could take it down and move it nnd deliver the material to him , provided they were direful and did not injure any of thu brick. Mr. Keller said if he moved it in bolialf of thu city , the material should never como south of the north side of the creek. Mr. Vauglmn wanted to know of the city attorney if Miller it Co. , had any au thority to cmnpot the city to move the old powder building. Mr. Holmes said ho had not given thu subject much thought but didn't liuliuvo they had , At this juncture John Limit arrived accompanied by Tim Toner. They came lo the rail and Mr. Limit began to pour forth his punt tin olo- Ho said : "I appear before you to-night in behalf of outraged immunity. Tlint innocent young man _ to Toner ) has boon grievously wronged" the hands of thu council. Ho has boon condemned and nearly executed without thu right of trial or benefit of clergy. Charges have been preferred against him by Chief of Police Field , of the most base nnd damnable character. Wo are hero lo answer these charges , and if , after an investigation , you find us guilty , we will be satisfied to ho led to the block. Mr. Yau lmn explained to Mr , Limit charges. IIo , simply had taken down the testimony ot sonic witnesses' to curtain facts'nnd reported them to the council. Mr. Limit wished it under- sltwd that Mr. Toner was in court to IIo answer to these charges , by whom soever preferred. IIo did not think .ho council did right to strip Tim of iis right to dress in a policeman's ; arb without giving him a chance to lofend himself. Mr. Toner being iroHcnt , spoke as follows : ' 'Misther Yarn and gintlcsmin ; bo plea nod to ; ivo mo a hearin' . I am innocent of ivory charge yous have prafcrred agin no. " Mr. litirkn suggested that ho road the answer filed by Mr. Limit , which was as follows : "titatoof Iowa , Council Chamber ; JJoforo the mayor and council. Chief II. II.'Fiold VH. ant and answering , says that ho denies each and every allegation in the plain- .if repetition. Hodonicstlmt ho worked igaiiiBt the interests of Bell Clover and in favor of Grace Halford. Ho . doilies that ho over courted favois from my of tlio alloy girls on the ground , hat ho was an ollicor of the city. ' [ Had ho known that favors were be stowed by those girls ho might have akon a hand. He denies that ho over appeared on the streets dressed in woman's clothes ; said ho thought too nuch of his uniform for that ; ho do- lies that ho wis over under the in- lluonco of intoxicating liquors. * Mr. Keller moved that the whole- matter : 1)0 laid on thu table. Dawson seconded ended the motion. The council ad journed to next regular meeting.
