Law & Order Look drunk? New MIP bill could get you nabbed 70th and Comhusker accident leaves one dead A car accident at 70th and Comhusker Highway left one person dead Tuesday. Shawn Spencer, 23, of Lincoln was heading south bound in his car on 70th Street crossing Comhusker Highway. He was struck in the inter section by a semitrailer travel ing westbound, Lincoln police said. John Buss, 41, of Concordia, Kan., was driving the semitrailer. Witnesses said Buss may have ran the red light, police said. Spencer was ejected from his car, Lincoln police said. Spencer was then taken to Bryan LGH-West, where he was pronounced dead. A third vehicle was also struck during the accident, but the driver did not report any injuries. Buss was cited and jailed for misdemeanor motor vehi cle homicide. 18-year-old teenage boy arrested for sexualassault Police arrested one person in a sexual assault Monday. Ali Tharis, 18, was charged with second-degree sexual assault after he assaulted a 50 year-old woman, Lincoln police said. Tharis went to the woman's apartment near P Street to speak with the woman’s for mer roommate around 10:30 p.m. Tharis then verbally and sexually harassed and inap propriately fondled the woman, Lincoln police said. The woman told police she told Tharis to stop. Tharis did not continue the fondling. ■ At tonight's meeting, ASUN members will vote to allow its lobbying arm to press for no change to the MIP law. BY MARGARET BEHM After senators spent last week preparing for a slew of bills, student government will vote tonight on whether to pass them. The Association of Students of the University of Nebraska will present four bills by President Joel Schafer. One bill will ask to send the Government Liaison Committee to lobby against LB 114, a bill that would change how MIPs are given and punished. The Government Liaison Committee is the lobbying arm of student government The legislation GLC would lobby against is proposed by Sen. Mark Quandahl of Omaha. Two factors need to be present to be charged with minor in possession of alcohol, Quandahl said. The first is that someone under 21 has to be within the proximity of alcohol, Quandahl said. What qualifies as proximity will be at the discre tion of the police, he said. The second factor is that a person would have to exhibit signs of consumption of alco hol, he said. Signs of consumption would be deter mined by police either through observations or through testing, he said. “The bill provides for a presumption of con sumption,” he said. Tim Keefe, staff attorney for Student Legal Services, said that presumption of consump tion is illegal. "It’s unconstitutional because people are innocent until proven guilty,” he said. An example of the presumption of con sumption is if a person drank in his or her own home (which is legal), then went to a party where beer was served, and didn’t drink- he or she could still get an MLR Keefe said. LB114 also proposes changes in the sen tencing of alcohol violators. Under the bill, if people get an MIP, their drivers’ licenses could be suspended for three months. The lobbyist also would fight to ensure the ASUN president will continue to have a seat on the Board of Regents. A third bill would have the GLC lobbyists persuade the Legislature to pass Gov. Mike Johanns’ budget for the university. Johanns rec ommended an increase in funding for the uni versity- the largest in a decade. The fourth bill will ask ASUN to endorse a class ring design. The Nebraska Alumni Association is planning on having only one design available for class rings. The meeting is at 6:30 p.m. in the Nebraska Union. Students can voice their opinions dur ing the meeting's open forum.
