of obligation - a moral responsibility
to their customers when choosing
what the store carries.
“It’s nude photographs of children
with their genitals exposed, and this is
offensive and repulsive to die average
person,” said Omaha protester Joe
McDaniels. The only people inter
ested in this material are those inter
ested in using children for sexual pur
poses and sexual abuse.”
But the photographs in question
were found not to violate any state
statutes regarding child pornography,
Lacey said.
“The material I reviewed does not
constitute child pornography as that
is defined under Nebraska law,” he
said.
Clothe the unclothed?
Because of Barnes & Noble’s
refusal to remove the art from its
shelves and the lack of legal means to
enforce such a removal, Bockoven
and others now seek to change state
statutes regarding child pornography.
Among them is Nebraska
Attorney General Don Stenberg, who
announced earlier this month that
Nebraska child pornography laws
must be reconstructed to stem die tide
of “erotic nudity” in Nebraska book
stores.
“Nebraska law appears to be inad
equate to deal with the current trend
toward the sale of increasingly
explicit photographs of nude chil
dren,” Stenberg announced to the
Unicameral’s Judiciary
Committee.
Kermit Brashear, committee
chairman, says nothing can be
done until the Legislature recon
venes in January.
That is, if sentiment is strong
enough.
Overwritten censorship laws and
extremist right views lead to the ban
ning of art forms like films and plays,
Lemieux explained. A law written to
outlaw nudity in bars and clubs could
also be used to prevent the musical “A
Chorus Line” from playing in certain
communities, he said.
Lemieux says he views occur
rences such as picketing bookstores
and book shredding as the result of
“extremist talk-radio hosts.”
“(ACLU) doesn’t think that one
group of people should be able to
impose their version of morality on
another group of people,” he said
Praised as a heroine by some,
scorned and derided by others,
Bockoven remains focused on the
issue that sparked the national debate.
“I believe we are here for a pur
pose and if helping children is my
purpose then I have done my part,”
she said.
