However, there is not enough evi dence to merit a charge at this time Deputy Lancaster County Attorney Amy Jacobsen said Wednesday. On Monday, Amy Trout of Lincoln filed an Ex Parte Protection Order in District Court asking for protection from Brown entering the premises occupied by Trout and from harassing and stalking her by either telephone or in person. Brown was served the notice on Monday and a hearing was scheduled for July 14, 1997. In the report Trout said she had lived with Brown in the past and he had fathered her two children, Kierra, 5, and Darian, 1. Trout said Brown had beaten her up before, once when she was five months pregnant with her son. She also said he had choked her on several occasions. On July 6,1997, Trout said Brown had been stalking her outside her apartment and only left when neigh bors came to her residence. She said he continued to harass her by phone until 2 a.m. by calling repeatedly but not talking and hang ing up. “I’m fearing for my life when he is around,” Trout said in the report. Brown had been arrested on Jan. 24, 1997 for a third degree assault of Trout. In the protection order she said Brown attacked her on a street and ran after her, grabbed her and slammed her down to the cement. He slammed her head against the cement hard enough to leave a large lump. The Lancaster County Attorney dismissed the case against Brown on Feb. 25, 1997, in agreement that he would participate in a Diversion Services Program. Court records indicate that a charge of violating a previous protection order filed by Trout against Brown was dropped in 1994. Protection orders typically expire after a year. Brown was an All-Big Eight run ning back for the University of Nebraska in 1991 and 1992. He left school early to play professional foot ball. ! sjoff mssi M«hs & WohN«hs L.
