Until the pardons board commutes
a lifetime sentence to a certain num
ber of years, good time for a reduced
sentence does not apply, Brown said.
Brown said legal proceedings would
be far from over if Bjorklund’s sen
tence was death. The Nebraska Su
preme Court automatically reviews
each case where the death penalty is
given, he said.
“After that, there is a series of up to
nine other levels of review that (a
person) can go through,” Brown said.
The final step, he said, would be
moving out of the judicial branch to
the executive branch by asking the
state’s pardon’s board to commute the
sentence from death to life in prison.
“It usually takes from six to 10
years to complete these steps,” Brown
said.
Lancaster County District Judge
Donald Endacott will determine
Bjorklund’s sentence alone instead of
conferring with a three-judge panel.
After the last piece of evidence is
entered at the sentencing hearing,
Endacott said he would have 90 days
to decide Bjorklund’s sentence.
