Students who believe they have been treated
unfairly by their landlords may soon have a
fighting chance.
Government Liaison Committee Chairman
Andrew Loudon said GLC would be investigat
ing discrepancies between Nebraska statutes
and the American Bar Association’s recom
mendations dealing with tenant/landlord rela
tions.
Loudon said he was concerned some Uni
versity of Nebraska-Lincoln students were not
being treated fairly by their landlords.
He said UNL’s Student Legal Services had
received large numbers of complaints each
year from student tenants who thought they
were wrongly fined or that too much of their
deposits were withheld.
Loudon has started keeping a record of the
complaints, hoping to find a way to aid stu
dents.
One solution he is investigating involves the
American Bar Association’s suggestions for
landlord/tenant relations.
Since 1975, Loudon said, the ABA has
recommended that tenants who contest the
return of their deposits could, if proven right,
win attorney fees and monetary amounts great
er than their original deposits.
However, the ABA suggestions do not have
to be adopted by individual states. Nebraska
state law awards only the original deposit and
attorney fees to tenants who take their landlords
to court.
Loudon said he was concerned about land
lords who owned more than one property. It is
possible, he said, that a landlord who owns
several properties could withhold all the ten
ants’ deposits, hoping only a few would sue.
In this scenario, even if tenants did take their
landlord to court and win, Loudon said, the
landlord would only pay what the tenants were
entitled to in the first place, the amount of the
original deposit.
Although the tenants also would be entitled
to lawyer fees, many student tenants seek legal
services at the Association of Students of the
University of Nebraska office, where there are
no attorney fees.
Loudon said he wanted to begin lobbying the
Nebraska Legislature immediately to have the
statute changed.
He is concentrating on finding senators who
would support the cause, and he is encouraging
students who believe they have been cheated by
their landlords to notify GLC.
“We need people next year to testify that
they have been ripped off (by their landlords),”
Loudon said.
He believes changing this statute could pre
vent landlords from taking advantage of stu
dents, because more money would be at stake.
