The rul ing came in response to a lawsuit filed by former Colorado cross country runner Dave Derdeyn, who claimed the university’s prac tice of rapid eve and random urine tests violated his constitutional rights. Devaney said Nebraska’s pro gram remaihs intact because he does not know all the facts sur rounding the decision by Boulder District Judge Joseph Bellipanni. Nebraska employs random urine tests to combat the use of steroids and other street drugs. If an athlete is suspected of using drugs, several steps may be taken, including suspension, counseling or notification of parents. Devaney said he was surprised by the ruling because testing is an effective way to “stop and at least curb” drug use. He said student athletes should realize that one of their responsibilities is to be tested for drues. , . Devaney said he never has had an athlete express concern about Nebraska’s drug -testing policy during his 23-year term as the Comhuskers’ athletic director. He said he would not necessarily sus pect a student-athlete was using drugs if he approached anyone in the Nebraska athletic department about its policy. Devaney said if a student-ath lete did approach him about Ne braska’s drug policy, he would first try to explain the importance of it. He said he would then try to find out what was the real reason for the athlete’s concern. Devaney said student-athletes who refuse to be tested are jeop ardizing their athletic careers. “Nothing says we have to let them play if they refuse,’’ he said.
