Stanford diver challenges NCAA By The Associated Press SAN JOSE, Calif. - A Stanford Uni versity diver who challenged the NCAA's drug-testing program for athletes won a preliminary injunction Wednesday that allowed her to compete without provid ing a urine sample. The ruling by Santa Clara County Superior Court Judge Peter G. Stone applies only to Simone LeVant, but it has broader implications for the thou sands of athletes across the nation under the NCAA's virtual control of col lege sports. LeVant is the first athlete to challenge the NCAA policy. Stone agreed with LeVant that the National Collegiate Athletic Associa tion's mandatory urine tests are an obtrusive and unconstitutional inva sion of privacy. Stone said there is a "reasonable probability" the case would win in a trial court. LeVant, a 22-year-old senior, will be able to compete in championship qual ifying events in Arizona this weekend and, if successful, go to the NCAA finals in Indianapolis in two weeks. Twenty-six. . .25 . . 24. . Nebraska and Marquette were tied 76-70 in the first-round game of the National Invita tion Tournament. Twenty. . .19. . .18. The Comhuskers, playing in their fifth-consecutive post-season tourna ment, brought the ball across the half court line. Fifteen. . .14. . .13. . .12. The clock ticked on. Nebraska had led by six points with eight minutes left in the game, but Marquette battled back to tie the game on a threepoint jump shot by Tony Smith with 27 seconds left to play. Ten. . .nine. . .eight. The clock kept running. The Huskers passed the ball back out to the point, then back in side. . .seven. . .six. . . five. Nebraska's Brian Carr took a pass from Henry Buchanan and found a gap in the War rior defense. Four seconds remained. Carr jumped and was fouled by Smith, but managed to get the shot away. As the ball swished through the net, the officials' whistles sounded for the foul. One second remained on the clock. Nebraska led 78-76 with less than one second remaining and Carr was at the free throw line. Nebraska coach Danny Nee said the plan was for Carr to miss the free throw intentionally, which he did. "We figured as soon as (Marquette) touched the ball time would expire," Nee said, "Brian hit it off the back board and then the rim and it hit (Tom) Copa on the leg and by the time he got ahold of it, the clock had run out." So had Marquette's chances of advancing t o the second round of the NIT. Once again, Nee said, Nebraska had found a way to win. "We're not a pretty team, but we work hard and find a way to win in this building (the Sports Center)," he said. Carr gave much of the credit for the winning shot to Buchanan for a good assist. " T (Buchanan) kicked it out to me, I penetrated the gap and put it up," Carr said. "I knew I'd get fouled when I went up." 4I think this came down to the big plays in the final seconds.' Dukiet By then, though, it didn't matter. The ball bounced off the rim, into the air and through the hoop. Nee's hopes for taking a Spring Break trip to New York City, his hometown, became more possible. "I think this game came down to the big plays in the final seconds," Mar quette coach Bob Dukiet said. "It came down to loose rebounds, free rebounds, foul shots down the stretch and a big shot with one second left. . . that's what this game came down to." What the game came down to the most for Nebraska is a second-round game either Monday or Tuesday at a sight to be named later. Nee is hoping that site is Lincoln. .
