Killenbeck said both the Arnold and Gates cases focused on deciding if there was probable cause to believe that criminal activity was afoot. In the Gate3 case the U.S. Supreme Court said "probable cause" shall be determined from the "totality of the circum stances." The law should require the police to observe an act that has strong criminal implications, Killen beck said. In the Gates case, he said, the police witnessed no criminal implications but requested and received a search and seizure warrant: only from allegations written in an anonymous letter.
