Many senators complained about the 15 minute time limit put on debate of general file bills. Sen. Chris Beutler of Lincoln complained that the bUl was being rushed and that he wanted time to consider amendments to the bill. , ,. . The bill, sponsored by Sen. Patrick Venditte of Omaha would take at least two years for the bill to take effect suming illicit drugs. . The bill would make illegal all types of bongs and water pipes, some balloons, scales, kits to enable one to grow illegal drugs and all types of pipes, with or without screens. . , . r ,u Discussion of the bill, opened by Chairman of the Judiciary committee, Sen. William Nichol of ScottsblufT, began with the consideration of three committee amend ments. Nichol claimed that allowing head shops in Nebraska is in effect telling the state's youth that drug use is all right. Form a paradox "Head ships form a paradox in the minds of our youth that drug abuse is OK," Nichol said . Sens. John DeCamp of Neligh and Neil Simon of Omaha said the bill, including the committee amend ments, would be unconstitutional. Simon said since the bill's conception, the attorney general has rendered at least five opinions on the bill and its proposed amendments. Four of the opinions stated the bill to be unworkable, he said. "It will be business as usual for two more years," Simon said, referring to DeCamp's statement. "The head shops will be able to operate as usual." Sen. David Landis of Lincoln disagreed with the bill's proponents, saying he did not feel that the presence of head shops meant the state had put its stamp of approval on drug use. Applying 'eyewash Landis went on to say that outlawing paraphernalia is merely applying "eyewash" to the real problem of drug abuse. "All it does is placate the public's desire in a complex area," he said. After the 15 minute discussion, the senators voted 37-8 to suspend floor rules in order to advance the bill. Normally, amendments to bills are first considered before a vote is taken. However, because of time constraints, the Legislature decided1 to change the pro cedure for the bill and it advanced unamended. Beutler protested that suspending the rules is not the way to conduct business. 'Exercise in futility' 'This is an exercise in futility," Beutler said, adding that he would like to have some other choices to consider before deciding whether the bill should be ad vanced. LB991 must yet pass through two more legislative hurdles before it reaches the governor's desk. Simon said he might attempt to amend the bill when it comes up on select file. According to an attorney general's opinion, Simon's amendment would make the bill "pass constitutional muster." The Simon amendment would alter the bill by clearly defining paraphernalia. Some opponents of the bill have complained that the original bill, which is verbatim of a model act prepared by the United States Department of Justice, would outlaw plastic bags and balloons. where can you save lotsa $$$ every Tuesday?
