Omaha case dismissed
A lawsuit brought by a UNL laW student in U.S.
District Court in" Omaha was dismissed Tuesday, accord,
ing to the two attorneys in the case .
No official court order was available Tuesday from the
case heard before U.S. District Court Judge Albert Schatz.
The lawsuit, filed by Robert A. Laughlin, a UNL freshman
law student, charges Omaha Westside School District 66
and its superintendents with 4illegal and unconstitution.

Charles Thone and Attorney General Paul Douglas to the
list of defendants.
Roger Holthaus, Laughlin's attorney, said Judge Schatz
Tuesday dismissed Laughlin's request for a preliminary in
junction against school board elections Feb. 21 and grant
ed the defendant's motion for dismissal.
Holthaus said it was his interpretation of the hearing
that the judge ruled the constitutional questions raised
by the suit were for the state courts to decide, not the
district courts.
Verne Moore Jr., attorney for the defendants, said he
understood the case had been dismissed. However, he de
clined to offer reasons for the dismissal until he could
read the judge's official order.
'The merits of the case still have not been heard,"
Holthaus said. He said he was surprised to discover during
the hearing that a motion to dismiss had been presented
since he had no prior notice of the motion.
Moore said he had filed the motion to dismiss Monday
afternoon.
Holthaus said an appeal or an independent action may
be sought to further the case, but cautioned that nothing
could be determined until he read Judge Schatz's official
order.
Holthaus added that he had received about 30 phone
calls Tuesday from District 66 members.
Laughlin filed the suit because he said the caucus that
selects school board candidates does not allow for
absentee, disabled or sick voters.
