Amiram Erwork, assistant professor of psychology who has been doing extensive research on sanity court cases, said that the public has two major concerns about Simants, who was found innocent by reason of insanity for killing six members of a Sutherland, Neb. family in 1975 and Is now uadergoing treatment at the Nebras ka Regional Center. Those concerns are that Simants would be set free soon and deciding who has the power to set Simants free. Erwork said because of the public's attitude about the Simants case, he would not be set free for a long time. He said perhaps mental health workers should report their findings to a judge and let either the judge or a jury decide if the person was sane enough to function in society. Nebraska's definition of insane states that an insane person must not be able to know the nature of his action or the differ ence between right and wrong. Elwork said there are two views for the elimination of sanity hearings. "Either position brings you down to a ridiculous view of things," Elwork said. He said if nobody has control over their ' actions, society would be lawless. There are those who do have self control and those who do not. For this reason, he said he had no doubt that there should be an insanity defense. Elwork said the Nebraska insanity de. fense law should be clarified so a jury knows what an insanity defense is.
