The appeal was made by the NU Board of Regents after the Nebraska Court of In dustrial Appeals found UNL police officials guilty of discrimination and harassment, according to J. Murry Shaeffer, union at torney that would represent the police officers. According to Shaeffer, three points were argued before the Supreme Court last Friday. They were whether the Court of Industrial Appeals had jurisdiction in the case, the size of the bargaining unit and whether the court's findings of unfair labor practices should be affirmed. Harassment evidence The Industrial Court on Dec. 22, 1977, found evidence of harassment and discrim ination on the part of UNL Director of Police Gale Gade and other police officials. The charges were made after officers Mary Fleming and Barb McGill were to be reclassified. McGill was pregnant at the time and Fleming had sustained a knee injury while off duty. The pair were to be classified as civilian clerks until they could return to active duty. The Industrial Court, however, found the actions "wholly il legal." According to court briefs filed by at torneys representing the Board of Regents, the Industrial Court had no jurisdiction in the matter because the Board of Regents are the governing authority over university matters. Constitutional provision In his brief, the late John Gourlay said the state constitution contains a provision preventing the legislature from interfering with the direction of university employees. Therefore, he said the Industrial Court, an arm of the legislature, had no jurisdiction in a dispute involving such employees. However. Shaeffer argued the intent of the constitutional provision was to prevent interference in determining the salary or compensation of such employees, but not "industrial disputes," such as the dispute involving the UNL police. There was also disagreement over the type of bargaining unit representing UNL officers. The Board of Regents contends, through the appeal, that UNL police should not be represented by a bargaining unit separate from other UNL employees. According to Local 567, however, special qualifications and restrictions placed on the police classify the depart ment as a separate unit. Chief innocent Gourlay also said in his court brief that Chief Gade was innocent of harassment or discrimination. According to the brief, Gade proposed that officers McGill and Fleming be reclassified to civilian status al lowing them to "maintain gainful employ, ment." Gourlay maintained that at the time there was labor-management difficulty within the department which the Industrial Court called unfair labor practices. Shaeffer countered in his brief saying that under both university and state rules and regulations, Gade was not permitted to reclassify the two officers. Schaeffcr discussed testimony concerning another female officer, Joy Citta, who was president of Local 567 during the fall of 1977. Citta claimed in testimony during the Industrial Court hear ing that female officers were discrimina ted against because of the cowboy style hats designed especially for them. Woman suspended Citta was suspended for six days over the dispute with Gade. Later Gade agreed to remove an administrative reprimand against Citta and reinstate her six days. Shaeffer contended that Gade reached his decision only after both parties stipulated that Gade's actions were taken without basis of fact. "It was not because of any benevolence on the part of the chief as the univer sity would lead court to believe," Shaeffer stated in his court brief. Shaeffer did dispute one finding of the Industrial Court in his argument before the Supreme Court. The Industrial Court said the bargaining unit should be limited to officers below the rank of sergeant. Local 567 contended all officers, except the two administrative officers that report directly to Chief Gade, should be included in the union. Currently. Local 567 is the unofficial representative of UNL police, but would not be officially recognized unless the Su preme Court found that the police should be represented by a bargaining unit separate from other UNL employees. The court briefs were filed last spring.
