page 2 daily nebraskan thursday, October 19, 1978 Defense lawyers protest alleged police misconduct in Ellis case short stuff The defense attornies handling the John Ellis preliminary hearing are upset about actions Lincoln police reportedly took th the night before the preliminary hearing started. According to Craig Wittstruck, an assistant to John Stevens Berry, Ellis' attorney, Ellis said he was taken out of his jail cell, and transported by patrol car to a secluded garage or dark building. Wittstruck said the incident happened, according to Ellis, despite his "vehement disapproval," and even though he asked to see his attorney, they were never notified. Lt. Ron Bruder, a night shift comman der at the police department, said he knows nothing about it. Deputy prosecutor Robert Gibson said he could not make a comment. "I wouldn't want to comment on anything concerning his case until the hearing is over." Gibson said. Both Berry and Wittstruck refused to comment on what Ellis said happened once they reached the dark, secluded building, but Berry said he intends to pursue the matter once the preliminary hearing is over, and may have additional statements to make later.
