UNL will lose the services of professor Gene Harding if he is elected state senator, according to an opinion issued by John Gourlay, NU general counsel. Gourlay said while Harding was a candidate, he would be governed by Section 3.9 of the Regent's Bylaws. It states that an employee of the university who considers running for public office must notify the chancellor and the division head of his college about his or her intention to run. Harding, a journalism and secondary education profes sor, notified UNL chancellor Roy Young February 16. Neale Copple, UNL School of Journalism Director, also was notified of Harding's intention to run. Young and Copple have allowed Harding to remain an instructor while a candidate as long as his campaign does not interefere with teaching duties. The Nebraska Constitution prohibits state employees from receiving pay from another state office while they are serving in the Legislature, Gourlay said. They also can not return to work or enter into a contract with the state until one year after the term's expiration. Gourlay said the situation would not be altered if Harding were to take a leave of absence without pay. Gourlay said he issued the opinion at Young's request. Harding said the decision to run was a hard one because of the state prohibitions. Although Harding said he can see the state's point of view that a state employee might try and legislate his own salary, he said the state law causes a hardship for state em ployees who run for office. "It is hard for public employees to campaign because of the demands of their job and because the campaign is watched more closely so that no rules are violated," Hard ing said. He referred to a proposal introduced last week in the Legislature by Sen. Howard Lamb of Anselmo which asked the regents to prohibit faculty members from using sick leave time for political campaigning. Harding said he felt the proposal was directed at him because he is the only faculty member campaigning. He denied ever using sick leave for political campaigning. The proposal is an example of how the activities ;f public employees are closely watched because of their visibility and accessibility, he said. Harding said he did not mind Gourlay 's ruling.
