Small turnout at claims seminar
David Rasmussen, Student Legal
Services Center lawyer, opened a series
of legal services seminars in the
Nebraska Union small auditorium Wed
nesday with a discussion on Small
Claims Courts.
Seven people, including Rasmussen
and his assistant, attended the seminar.
Small claims courts were created by
the Legislature about two years ago to
handle legal disputes on claims of less
than $500 and, according to Rassmusen,
"a lot of people have used them rather
successfully. ' '
Although "the process is usually
informal," Rasmussen said students
"probably should talk to an attorney
first since there is one on campus."
"Getting ready to sue somebody is a
pretty important matter," he added.
Willing to help
Both the court and the Student Legal
Services Center are willing to help
prospective court users, he said. There
are 94 small claims courts in Nebraska
counties and Lincoln and Omaha have
municipal Courts, Rasmussen said.
Allnrnave arn nnt qIIhaoH in 3 Small
claims proceeding, Rasmussen said, so
therp are nn lawver's fees to oav.
The claims procedure is informal and
varies from county to county and judge
to judge, Rasmussen said. The court
requires the claimant to state what he's
asking for. Rasmussen said he's. seen
such simple statements as, "I want my
money back." , ,
Notice served
He said defendants have notice
served to them either through the mails
or in person. He cautioned, "If a
defendant As a shifty character, the
notice should be served in person."
He said a disadvantage of the court is
that "if you are facing a really shifty
type of character, taking a small . claims
court adjustment may not do much for
you because it could be tough to
collect." He said many times it is also
"a hassle for regular attorneys In
regular courts" to collect a settlement.
Rasmussen said that he "didn't
expect a large turnout" at the seminar
since President Gerald Ford was in town
and "because of the lack of publicity."
He promised "a lot of posters" for the
next three seminars in the series. The
next seminar will be Oct. 30 at 2:30 p.m.
and will be about drunken driving.
