Gazette distribution challenge postponed The Lincoln Board of Education has postponed a decision regarding an appeal of a Federal District Court injunction against the board which permits the Lincoln Gazette to distribute its publication on private property. According to a story in the Lincoln Journal, Willis Hecht, legal counsel to the board, told the board Tuesday he would not be willing to carry the appeal forward unless there was a unanimous decision to do so. "It needs to be an all or none decision and you need to plan to go all the way," Hecht said. Reaction from board members centered on the principle involved in the loss of the right to govern what takes place on school property, weighed against the added publicity an appeal would give the newspaper. "The Gazette's life is geared to the size of the stage it plays on," Ted Dewey, board member, said. He said he had not yet decided how to vote. Dewey predicted the Gazette "will have us back in court." John Prasch, Lincoln superintendent of schools, said he has reversed his opinion in the past two weeks. At the last board meeting he said he believed the situation should not be dignified by "giving it a larger stage than it deserves. I believe we have" more important things to do. But there's a principle involved here that asks the question, what control do we have? I'd like a better answer to that." Dr. John Lux, board chairman, reminded the board that two principles are involved: the right of the board to govern school property and the right of the individual. "We have to woirjh one against the other," he said. According to the Journal Hecht said he believes the Gazette desires further confrontation and predicted that it is not a permanent publication. Ho said Judge Warren Urbom's decision represents the majority of decisions coming out of federal courts, "but I don't agree with the majority." The court order included a suspension to enable the defendant's to formulate regulations regarding the distribution of materials.
