The exact reason why the Tribunal hearings are not public unless sanc tioned by the defendant (and who wants publicity) has not been explained very fully or recently. Be sides 1 do not feel that any reason could justify such a violation of the rights of press freedom as guaranteed by the Con stitution and the First Amendment. The hearing involving these two stu dents who were suspend ed, their names and the information concerning the arrest should have been made public. As Justice Reed of the United States Supreme Court said in the case Pennekamp v. Florida U946: "A free press is not to be preferred" to an inde pendent judiciary, nor an independent judiciary to a free press. Neither has primacy over the other; both are indispensable to a free society. The free dom of the press in it self pre-supposes an inde pendent judiciary through which that freedom may, if necessary, be radicat ed. And one of the potent means for assuring judges their independence is a free press."
