Council Judiciary Committee Announces
Interpretation of Rules for Fall Election

These are the rules govern
ing student election proceedings.
They were formulated by th
Judiciary committee of the Stu
dent Council and will be rigidly
enforced in the coming fall cam
paign.) The committee agrees on the
following definitions and interp
retations of Article IV of the rules
of student elections: Article IV:
No vote shall be solicited at the
polls or in the building in which
election is being held during elec
tion day. No money shall be spent
in behalf of any candidate. No
printed, mimeographed, typed, or
otherwise published material in
behalf of any candidate shall be
permitted except the impartial an
nouncements of the candiates ap
pearing in the press. Any candi
date violating these rules either
in person or thru his supporters
shall thereby become ineligible.
No Solicition of Votes.
"No vote shall be solicited" shall
mean: No person eligible to vote
for any candidate shall be influ
enced in any way at the polls or
in the building in which the elec
tion is being held by means of the
spoken or written word of any
other means, to cast his or her
vote for any particualr candidate;
nor shall any such person be in
fluenced in any means to vote at
all.
"At the polls or within the build
ing in which the election is being
held" shall mean: Any place
within said building or within one
hundred feet from any part of the
building. Exception: Any regu
larly assigned offices on the third
floor of the Union for Int erf rater
nity and Barb Council. The phrase
"at the polls" shall mean: At the
place, or places, where passing
out of ballots to voters, marking
of ballots by voters, and placing
of ballots in the ballot boxes is
taking place.
"During the election day" shall
mean: Shall be exchanged at any
time from 12 midnight of the day
preceding the election to the time
that the polls are officially closed.
Money Interpretation.
"No money" shall mean: No
cash, checks, mail orders, drafts,
stamps, credit or any other article
of value.
"Shall be spent" shall mean
Shall be exchanged, traded or
given away in any manner.
"In behalf of any candidate"
shall mean: No money shall be
spent which would in any way in
fluence the results of the election
or in any way influence a voter to
cast his vote for any particular
candidate, or candidates, whose
name, or names appear on the
ballots. The term candidate shall
include both persons whose names
appear on the ballots, and also the
political parties with which they
may he affiliated. This definition
of candidate shall be followed
wherever the term appears in this
article. A person whose name is
to appear on the ballot shall be
considered a candidate from the
day of his filing for office.
Posters Not Allowed.
"No printed, mimeographed
typed, or otherwise published nia
terial" shall mean: No handbills
posters, papers, newspaper or any
other type of materials or adver
tising on which appears any writ
Ings, tying, printing, cartoons, 1
drawings, photographs or any
other type of pictorial representa
tion of thought, which material is
transmitted to any voter by any
means whatever or is posted in
any place except the inside of a
private home, boarding house,
rooming house, fraternity house or
sorority house, except the official
posters of the elections commit
tee of the Student Council. Any
such material posted in the uni
versity residence halls for women
except official publicity of the
elections committee shall be con
sidered "published material."
"Shall be permitted" shall mean,

this article.
Ink Must Be Same.
"Impartial announcements" shall
mean: A list or an candidates tor
all offices to be filled by the elec
tions, in which list the candidates'
names must all appear correctly
spelled, in the same kind of type,
in the same color and shade of ink
with no extra markings of any
sort beneath, over, around, or be
side any particular names which
markings does not appear in the
same way by all the names in the
list. Such lists may contain the
political affiliations of all candi
dates but no other information
about them. Official posters by the
elections committee of the Stu
dent Council shall be considered
impartial announcements.
"The press" shall mean: Any
publication which has the ap
proval of the University of Ne
braska publications board. In all
cases the editors of the publica
tions shall be held directly respon
sible for what appears in the pub
lication.
"Violating these rules" shall
mean: in any way causing tne
rules of this article to be broken
or infracted.
Ignorance No Excuse.
"Either in person or thru his
supporters" shall mean: Either by
a personal action or by the action
of any one of his supporters or by
any member of the political fac
tion with which he affiliated, no
matter whether or not he knows
such action will be taken, is be
ing taken or has been taken.
In considering the definition of
the term candidate the penalty of
violation of a rule shall apply only
to the individual with whom the
violation is concerned. If the vio
lation is concerned with a pojit
ical party, then the penalty shall
apply to all nominees affiliated
with that party.
Ignorance of this article and its
interpretation shall not be con
sidered a valid excuse for the vio
lation of the rules of this article
ither by an individual, a group
of individuals or a political fac
tion.
Regular news items appearing
in the press (defined above) and
concerning any candidate shall not
be considered as violations of this
article unless they contain edi
torial comment aobut the candi
date or unless they are not im
partial.

Throbbing hearts will be the
theme of Nebraska's red and
white clad varsity band at Sat
urday's homecoming game.
During the half the band will
first march out to form a huge
T in salute to Indiana U. After
one chorus of "Indiana, Our In
diana," the band will move di
rectly Into the heart formations,
outlining one big heart flanked
by two smaller ones. Doing a pre
cision waltz step, the 114 men
will move back and forth to the
tune of "I Love You Truly."
Then, with "Sweetheart of Sig
ma Chi" as its theme, the two
smaller hearts break up to form

Turned in Monday at 5
Three application pictures of
candidates running in the fall elec
tion must be turned in by Monday
at 5 p. m. to Marjorie Bruning
at the Daily Nebraskan office,
Dick Harnsberger, chairman of the
student council elections commit
tee announced yesterday.
The three pictures are necessary
since the council makes up three
posters of all candidates pictures
which will be placed in the Union,
social sciences and on ag cam'
pus.
This idea was first used last
year when the council needed some
method of campaigning which
would be fair for all candidates.
This is the only method candidates
may use in campaigning in any
way or their names will be with
drawn from the slate.
Filings close today at 5 p. m. in
John K. Selleck s office in the con
seum. Junior, senior and sopho
more class presidency positions
are open at well as the Nebraska
Sweetheart and Honorary Colonel
The elections will be held Oct. 28
The extra time was given stu
dents to get pictures in since the
elections committee felt that the
pictures could not be in by 5 p. m
tomorrow. Monday at 5 p. m. is
the absolute deadline for these
however. Any who can turn in
their pictures before then should
do so on Saturday.

who lias made amazing progress
since he began playing a piano
at the age of five, and a 19-year
old North Dakota girl who already
has won many honrs in writing
and acting, have been selected as
ret ipients of the first Kay Kyser
scholarships in music and drama
recently established at the Uni
versity of North Carolina.
The winners are Elaine Lucille

Established last June thru the
Kay Kyser foundation, which has
been endowed by the famous Tar
Heel band leader, a U. N. C. grad
uate who organized his first band
heie, the awards are based on
character scholarship, leardcrship,
achievements and promise of fu
ture distinction. They provide tu

two concert numbers, "Deep In
My Heart" and "Drums in My
Heart." As every member of the
band performs trick steps the dou
ble heart seems to throb.
Before the game the Husker
organization will take part in the

tie, 1940-41 pep queen. They will
spell out the letters Q-U-E-E-N.
