Wakefield, a traveling man who lives in Beatrice, slipped on the sidewalk at St. Joseph the other day and broke his leg in two places. Fire in the second story of the old court house at Wahoo threatened for a time to destioy valuable records, but the tire department scon got the upper hand of the blaze. Father Joseph Bartek.. who has been the Catholic priest at the Bohemian church in Plattsmouth for four years, is to be succeeded by Father Nowatna the first of next month. Charles Ford, a saloon keeper at Decatur, in Burt county, was ai rested for selling liquor to minors. He was tried in the county court and fined for givinu i.qiior to minors. Farmers say that thousands of quail are starving to death in Otoe county. The country roads are lined with quail starching for something to eat and in many cases the little iellows tlv into barns and granaries in search of grain. The thawing and freezing of the snow of the last thirty days has loimed coatings of ice over the ground through which the quail cannot "-ciatch to secure food. Mr. and Mrs. diaries Gillam of Chadron. awakening the other morn ing found their 14-nionth-oid boy hahy dead in his crib. He had not been very well for a few days, but seem ed all right when the parents fixed him for the night, and no sound was heard. For the first time in several years, the river has been frozen over at Ne braska City, in a manner that it is considered safe for loaded teams to cross on the ice. Iowa farmers are taking advantage of the free bridge and coming to the city daily in large numbers. At Fremont Fred Spaulding was bound over to the district court on the charge of stealing $45 in cash and an overcoat from his uncle. L. L. Greeno. while the latter was In jail. He could not give bonds and went to jail to await trial. The Royal Highlanders of Grand Island have adopted a resolution de claring "That Dunnottar castle in dorses house rolls Nos. S5 and Sfi. in troduced by Hons. Ferrar and Kyd. feeling assured that said bills are just, equitable and for the best in terests of the government of fraternal beneficiary societies." Joseph Woods killed four red foxes near Rock Bluffs, south of Platts mouth. and their rdts are now on ex hibition in that city. The hunters say that it is very seldom that they find an animal of that kind in recent years in Nebraska. John Matea, a young Polish lad who lives in Nance county, is at SL Mary's i hospital in Columbus, with a ri ir of froze: feet and the chances are that both will have to be amputated. Jonn tried to dodge the sheriff, who wanted him on a charge preferred by a Polish girl near Genoa, and thus exposed himself to zero weather. PASS RATE BILL Ecch-Townssnd Measure Approved by House. WASHINGTON After nearly four days of discussion the house on Thursday by a vote of 326 to 17, pass ed the Esch-Townsend bill providing for the regulation of freight rates. The negative vote was made up of eleven repubicans and six democrats. Closing hours of the debate were occupied by Messrs. Williams of Mis- , souri. and the minority leader and Hepburn of Iowa, chairman of the committee which reported the hill. Mr. Williams, while supporting the minorty measure, even though he said he knew it could not pass, compli mented the republicans for bringing in a bill which was much better than he expected would come from them. The sneech of Mr. Hepburn was rather in defense of himself. He said j that his deeds and acts were a suffi- j cient answer to the "lies and sland ers" which had been heaped upon him. The bill known as the Hepburn bill, he said, had been prepared by the attorney general, and he only yielded to his colleagues on the committee on the Esch-Townsend bill because he did not want the committee to be the target for scribblers who wanted sen sational headlines. He devoted some time to a strong presentation of the merits of the majority measure. The closing remarks for the minot ity were made by Mr. Williams (Miss.) who at the outset congratu lated the house upon the fact that not only in the matter of rate legislation, but in several other particulars Presi dent Roosevelt, "nominated by the re publican party and elected by the peo ple," was beginning to assume a dis tinctly democratic attitude. Mr. Hepburn (la.) chairman of the committee on interstate and foreign commerce, closed for the republicans. He explained the difficulties of pre paring such a measure as the bill re ported, saying no two men entertain ed the same opinion either as to what was in the bid or what ought to be in i-. The substitute i,ni of the minoritv was defeated, 151 to 18G. Messrs. Gaines (Ten:i.). Rider and Scudder I (N. V.) and Livernash and Wyann I (Cai ), voting with the republicans. Tho roil then was called on the Esch-Townsend bill, which was pass ed, 3J0 io 17. TO RSACH THE PRIVATE LINES Proposed That Senate Committee Shall Sit During Vacation. WASHINGTON The resolution to be introduced in the senate by Mr. Kean of New Jersey, providing that the committee on interstate commerce shall sit during the summer for the in vestigation of the subject of railroad rate legislation, will not be offered until it has first been approved by the committee. It had been announced that the resolution would be present ed in the senate yesterday. The in terstate commerce commission will meet Saturday to consider the resolu tion, i The plan to have the senate com- I nuttee investigate thoroughly the subject of rate legislation has been approved by a large number of sena tors of both parties. It is said the committee will work along the line of perfecting the Esch Townsend bill and incorporate in that measure a provision to reach private car line?. The idea is that the committee is ready to report in October or the 1st of November, notice shall be sent to tre president, and if he is so inclined an extra session may be called. Should there be a demand from any senator for immediate consideration of the house bill it is planned to ascertain the sentiment of passing a rate bill at the present session by a vote on the proposed Kean resolution. MORE LAND FRAUD FINDINCS Former District Attorney at Portland Indicted. PORTLAND. Ore. Ex-United States Attorney John H. Hall was indicted by the federal grand jury in connec tion with the federal land fraud ca SeS j in course of investigation. The indictment against United States District Attorney Hall is for alleged participation in a con spiracy to prevent and obstruct the free passage over and the free use of the public land situated in Wheeler county. The document also alleges j that threats of violence and other means of intimidation were used to drive legitimate householders already settled on the land from the vicinity. Among the defendants named, in addi tion to Attorney Hall, are Congtess man Binger Harmann. Clark F. Loom is and nine others, all of whom, it is alleged worked in the interest of the Butte Creek land, lumber and live stock company. A second indictment returned charges Henry Meldrum and asso ciates with having conspired to de fraud the government of the United States by false and fraudulent sur veys. Minority Report on Ship Subsidy. WASHINGTON A minority report on the bill known as the "ship sub sidy" measure, was filed in the house Tuesday by Mr. Lucking (Mich.), rep resenting the views of the democratic members of the house committee on merchant marine and fisheries. The minority favors a discriminating high tonnage tax against foreign vessels, if not in violation of treaty obliga tions and large mail payments to the new lines to South America. Central America. South Africa, West Indian and Asiatic ports. Panama Act Constitutional. WASHINGTONJustice Stafford of the equity court decided against War-: ren B. Wilson, a Chicago lawyer, who i sued for an injunction to restrain the j secretary of the treasury from paying the republic of Panama any of the amounts of money provided for under : the treaty of the United States with , Panama. Wilson, in his suit, which he brought at his own initiative, alleged that the Panama cana act was uncon stitutional and that the United States was without right to acquire foreign territory.
