There is no danger that the country will be taken by surprise by its legislators in tbe enactment of laws for curbing tbe power of transporta tion companies, or making them, in any strong sense, amenable to the principles of ordinary justice be tween man and man. Tears ago the only question seemed to be whether the state legislature had tbe legal right to undertake to regulate freight rates. Serious attention seems now mainly attracted to national legisla tion, with a view to the regulation of inter-state commerce. Two measures were pushed to the front at tbe last session of congress with this end in view, resulting in a conference com mittee. It is now understood that this committee are ready to report, and that, anally, we are to have tbe best features of the Reagan and Cul- lorn bills. Both prohibit unjust dis crimination against persons and places, giving special rates, etc. If a good beginning has been made, this congress will not have lived entirely in vain. The appointment made by Presi dent Cleveland of Dr. Dabnoy to a position in the Pension Department at Washington, shows the least re spect possible for public opinion on tbe part of the President. Dabney was a rebel guard from Anderson ville prison, one of the most detest able places on earth. A position where he can pass upon the merits of union soldiers' pension claims, is one of the last that should be given him. The editor or the Clark's Messen ger seems to have a very strong pre judice against Senator Van Wyck. It is a little peculiar that the great body of tbe people are favorable to Van Wyck, and the body of politi cians opposed? The trouble with most of these fellows who are talking against Van W)cl: is that they can se6 no good whatever in anything he has done. Shellenberger, tbe father who so cruelly and unprovoked, murdered bis own daughter, twelve years old, to obtain money left her by her mother, was sentenced last week by Judge Pound to be executed March 25th. Today at precisely twelve o'clock tbe gavels fell simultaneously in both ends of the Capitol. They called to order more than a quorum of Representatives in the House, and nearly the full number of Senators. As usual, there were crowds of peo ple at the Capitol long before the ap pointed hour and every inch of stand ing room in the visitor's galleries was taken an hour before tbe opeu ing. The Capitol was in complete retdi uess for Congress, and all the official p were at their posts. The Senate Chamber looked very sombre draped with tbe Arthur mourning, but otherwise the Senate wing inside and out looked bright and fresh. The President's and Vice-President's rooms, the reception and marble rooms, bave all had a renovation during tbe reoess, and look better than ever before. Two new Senators were sworn in ex-Gov. Cheney of New Hampshire, and Mr. Williams of California, and in tbe House, three new members took the oath of office, namely ; Mr. Cox in place of Mr. Pulitzer. Mr. Bacon, in place of Mr. Beach and Mr. Rusk in place of Mr. Cole. As to what legislative business either the Senate or House will first give its attention, it is impossible to in dicate. The Senate is a body which follows the judgment of the hour in such matters dcBpite special oidors for fixed dates, aud an for the House, its vagaries are proverbial. There is a vast amount of work that ought to be performed this ses sion, but most of it must inevitably fail to teceive consideration. Waste of time during tbe long session is tbe chief causa of this discreditable situ ation. Still this is not the first Con gress that has wasted time and neg lected duties, nor is it likely to be tne last mat will can tor such cen sure. Affairs at tbe White House have been quiet during the week with Mrs. Cleveland in New York City buying Christmas presents, and the Presi dent confined indoors with rheuma tism. The Hungarian artist Mr. Mumbacsy was the lion of the week In the social world, and Consul Stewart of Antwerp, one of the old est and most popular consuls in the service was treated with marked kindness at tbe Executive Mansion during his sojourn in the city. He dined several times with the Presi dent, was bis guest at the theatre, and at t:Oak View" and finally ac companied Mrs. Cleveland to New York. The President's rheumatic pangs did uot prevent his making some im portant chauges in the Treasury De partment, during the week, amount ing io aimost a clean sweep of tbe Republican officials. Speaker Carlisle assisted the president upon that part of bis message relating to Tariff reduction, and while so engag ed tbe White House was besieged by members of Congress who were anxious to get to the president in order to influence him in the prepa ration of the document. Some Democratic anti-Civil Ser vice reformers are much disgusted that Secretary Lamar should have a Republican for his private secretary. They claim that be thus gives com fort to the opponents of tbe Admin istration by confirming the campaign declaration that the Democrats are incapable of controlling this country. So delicate and confidential are tbe relations between a private secretary and his cbier that tbe choice would seem to be Mr. Lamar's affair exclu sively, but it proves a source of great humiliation to tbe party which voted for a change of Administration. Doubtless if tbe whole truth were known, it would be that tbe Secre tary carefully looked over the whole , field aud failed to find a Democrat fitted to the position. There is no doubt but tbat there would be a great decrease in tbe fashion of Seuators and Representa tives living iu hotels and boarding houses here' while they leave their families at home, were it not that political capital is likely to be made out of their purchase of property in Washington. Many of them find it more economical to buy than to rent a house for the term of residence here, but no sooner does a Senator or a Member purchase a bouse, than political opponents circulate among his constituents tbe unpopular report that he is living at tbe Capital in princely style. It was a good reply tbat Congressman Butterworth made during tbe recent campaign to an at tack upon his modest Washington home. Substantially he said, "If more members of Congress lived un der the restraining influence of fami ly life in Washington, it would be better for them, for their families, and for legislation. It Ib tirao tbat the fog should be cleared away from this subject, that it may be presented to the larruers of Nebraska In its true light. The pro ducers of your state are, for the most part, about six hundred miles from available markets. The railroad-? tbat take their hogs, cattle, grain, aud produce to these markets, must cross the lines of two or three different states. The distance to be traveled in Nebraska for such purposes is comparatively small. The politicians who have promised to accomplish anytuing for the benefit of your farmers in the way of reducing freight charges on their productions to markets outside of the state, or have permitted them to believe tbat such results might be attained through state legislation, are guilty of misrepresentation, if not actual fraud, upon their rights. Congress nnder the United States Constitu tion, has the power exclusively, and it is prohibited to tbe states. Such has been the ruling ot Judge Mc- Crary in the U. S. Circuit Court, aud of the Supreme Court of the U. S. Your people should understand tbis matter thoroughly and be hood wink - ed no longer. It will pay to be honest with the masses 'once in a while. The act of Congress incorpo rating the U. P. R. R. Co., reserves tbe right to alter or amend its charter. No sane persou doubts the power of tbat body under such reservation, to regulate its charges within the limits and across the lines of any state or territory through which its road runs, it is, however, a more serious question, whether any state legisla ture would have the power to regu late its tariff or charges, even within the boundaries of tbat particular state wherein it operates a large part of its roads, on the ground tbat it is a creature of national legislation. An attorney of the U. P. has intimat ed to your correspondent, that the company proposes to raise tbat point, if ever the proper time ar rives.
