aio equally interested in tho outcomo of tho caso thoy are all represented at the hoariug today Tho C St P M As O is represented by J B Barnes attorney for tho Nebraska division Tho V E As M V is represented by A II Merchant assistant gonoral freight agent B T White general attorney II J Gansou of General Manager Uidwolls oflice The Union Pacific by O 1 Lane assist ant general freight agent Tho case was opened by R A Stewart who stated tho matter of complaint is pquarely within tho jurisdiction of tho board who aro employed by tho peoplo and not by the railroads and should see that justice is done every community He cited several cases where business men hud attempted to ship goods from Omaha to Norfolk via the O St P M As O but that road would not accept such shipments It was shown that Omaha is 1 12 miles distant via the C St P M O and 11 miles over tho F E M V Other remarks were made before tlio formal complaint was read by F II Free Dr Bear Herman Gerecko R B Weller L Sessions C S Bridge C D Jenkins N A Raiubolt and G M Thompson but the lateness of the hour precludes the possibility of giving a synopsis of tho lemaiks today although n moro extonded report will bo made for tomorrow At the time this report closes tho formal complaint of the Business Mens association of Norfolk against tho O St P M As O railroad company is being read lim Siitunliijs Uailj The hearing given to tho Norfolk business men yesterday by tho stato board of transportation was closed last uight about 10 oclock and at least two of the points contested for by tho Busi ness Mens association weio honored with ordors from tho board Tho first was that an order be issued to tho M As O road reducing tho freight rate clmrgo trom South Sioux City to Norfolk from J 2 cents to J15 cents Tho other was that tho road bo ordered to receive freight at Omaha for shipment to Nor folk Tho board had homo question re garding their jurisdiction in tho matter of compelling tho road to publish a tariil aud keep it posted in a conspicuous place and ready of access and this with other complaints was allowed to stand over The first effort made by tho represent atives of tho Business Mens association in tho afternoon was to have the board listen to the statomontb aud opinions of tho merchants present Mr Smyth thought that what tho board first wanted was definite evidence and thoy did not caro for tho speeches until after the ovidenco was in Mr Free and Mr Johnsan considered that the stateuiants of citieus was of considerable importance ab the board had come to listen to tho complaiutBand the expressions on the part of cltieus might have an important beariug on the case The board then expressed its willing ness to stay here until the case was thoroughly presented and signified its readiness to hear what the citieus had to say Mayor Simpson was tho first to address tho board and as usual was up to the occasion stating that Norfolk felt that it had a fight for its cxisteuce on hands and called attoutiou to the dibcrimiua tiou under which tho city was laboring Simple justico was asked Tho cltions aro not aftor tho railroads nor tho state board of transportation but wore after justico Dr Bear was called up for lenmrks Ho said that tho complaint was ono of tho oitions of tho town not an individ ual complaint and that Mr Johnson has hoarty sympathy of tho peoplo in his offorts Herman Gorocko did not supposo tho board was hoio to bo harangued but wanted ovidenco from which to form an opinion Had been in business horo since ISfi and if tho conditions then prevailing could bo returned ho would bo satisfied If tho law creating tho stato board of transpoitatiion and the interstato commerce law could bo re pealed those conditions might again prevail Before those laws went into effect if ho had any complaint concerning freight rates ho would go to Mr More honso and ho would always 11 it for him R B Wollor Had no facts to present particularly but was in hearty sym pathy with tho movement Had not entered into tho question sulllcient to givo facts and figures Louis Sossions Dr Bear oppressed my views Am in heaity Hynipit by with tho movement O S people In heaity sympathy with Mr Johnson N A Raiubolt Not much of a ship per either in or out but had heard con stant stroma of complaints regarding rates from both in and outshippors In tho noigboihood of a doon persons had endeavored to start wholesale houses horo but were beat in freight rates Tho railroad facilities were amplo to give them control of a largo territory but could do nothing with prevailing ratos Had 11 head of cattle at Plain view Couldnt loam what it would cost to ship them but was told it would be all light Was charged 1S Could havo driven thorn down for fil to 5 Had DA bend at Wakefield Was told it would take two cars aud costal 1 to ship to Norfolk Could drive them through for about 10 Freight to South Omaha on same shipment only - and threo times tho distance Tho pooplo aro in hearty accord with Mr Johnson Somo may draw their breath m on account of passes but their sympathy is with tho movement G M Thompson Am a shipper from Omaha Mr Johnson voices tho senti ment of the business men Would hko to see this a distributing point and a just rate made on carload lots Mr Laws stated that the expressions of tho people seemed to provo that Mr Johnson had their sympathy Tho board doesnt question it Think no proof to that effect is necessary The public correspoudonco between him and Mr Johnson was of a perbonal nature insofar as the boaid was concerned He had not entered the controversy in his official capacity The complaint was here read by Chester A Fuller secretary of tho Busi ness Mens association This consisted ot three typo written pages It gavo a review ot previous eflort3 niado in the somo direction and went on to recite tho several complaints in detail there boing 20 sections as follows The Norfolk Business Mens Associa tion against tho Chicago St Paul Min neapolis Omaha Railway Compuny Tho Norfolk Business Mens associa tion ot Norlolk Neb respectfully represents to the honorable Board of Transportation of tho stnto of Nebraska and for its complaint against tho Chi cago St Paul Minneapolis Omaha Railway company alleges Fiist That on the 18th day of Do comber 18S tho complainant filed with this board a written complaint against tho Chicago St Paul Minneapolis iV Omaha Railway company said com plaint being prepared under and by the direction and suggestions of tho secre taries of said board J O Dahlman and G L Laws and later on a similar complaint verified undor oath as re quired by law was filed with this board and on tho 27th day of June IbiW this board by its secretaries J W Edger ton and G L Laws hold a mooting or hearing on said complaint at Norfolk Nob Second That tho ovidenco there offered by this complainant among other mnttors showed to this honorable board that tho said Chicago St Paul Minneapolis Omaha Railway com pany did not at that time havo and keop open for public inspection tariil sheets or schedules of its charges for tho carn age of freight from South Sioux City to Norfolk Nob nor tariil sheets or schedules of freight rates from and be tween Omaha and Norfolk Neb in a public placo in its said station houso in Norfolk Nob as required by section 1 chapter lxii Compiled statutes of Ne braska Third That this honorablo board by its secretaries G L Laws and J W Edgorton at tho said hearing promised this complainant that an order would issue immediately to tho Chicago St Paul Minneapolis Omaha Railway company commanding them to publish such tariffs and at tho samo time tho suid secretaries decided that the ques tion of discrimination or injustice in said rates could not Ihj determined until tho baid railway company published tho requited tariffs and the honorable board did then adjourn Fourth That tho period of eight calendar months has elapsed and deter mined since tho Into of said hearing and no official notice has as yet been re ceived by this complainant that tho promisod order has been made to tlio ofl ending railway company nor has nuv official notico been received by this TIIR NORFOLK NEW THURSDAY F1WIIUARY 1000 complainant of tho final disposition of the said complaint nor of any finding of facts ns required by section 10 chapter Kii Compiled Statutes of Nebraska although this complainant admits that coitain daily papers of the stato repotted tho said complaint as dismissed Fifth That this complainant docs now for tho thud time allege that tho Chicago St Paul Minneapolis Omaha Railway company giossly dis criminates against the city of Not folk Neb by giving to other localities no moio favoiably situated and in some cases less fuotably situated better tatcs and has done so for moio than ten vents last past and in open iolation of section 2 chapter lwii Compiled Stat utes of Nelnaska Sixth That the said Chicago St Paul Minneapolis it Omaha Railway company does not at this time keop posted in its station house at Not folk Neb a published tat ill sheet or sched ule ot tales and classifications in a public place of ready access to the pub lic and this complainant respectfully asks that this honoiablo boaid or a com mittee of tho same make a pcisounl in speetton of the said station house at this time as the said boaid is empowered to do under section 17 chapter lwii Com piled Statutes of Nebraska Seventh- That the Chicago St Paul Minneapolis V Omaha Railway com pany publishes a tunli of uites fioin Siou City la to all stations on its line and also publishes joint tin ills to all other Nebraska towns and that while there is no material ditlerouco in the rates tioin Sioux City la land South Sioux City Neb to tlio towns along its lino of milwiiy or to towns to which it publishes a joint rate no such tat Ills ate published gning rates limn South Sioux City Neb and the said imlway company by this menus evades and escapes the jurisdiction of the Nebraska Mould of Tiauspoitntiou and will thus escape and evade tho law as long as this honorable board allows this condition to exist Eighth That the Chicago St Paul Minneapolis As Omaha Railway com pany does publish a tin ill of tates tioin Omaha to all stations along its Hue of road except Noi folk Neb and exami nation of that tnntl sheet shows Hope a small switch a little mote than one mile f loin Not folk to bo tlio last station on the line and the only way to ship I torn Omaha over the Minneapolis Aj Omaha would bo to bill tj Hope and then hope that some agent would go to Hope where there is no depot anil no hope ot there ever being one and lcbill into Noiiolk one mile and the above mentioned failure to publish tan lis of rates to eery point on it- line of road is in open violation of section chapter 72 compiled statutes ol Nebiaska Ninth That on tlio lith day of Feb ruary 11100 a shipment of lreight was offered and tendered to the Chicago St Paul Minneapolis Omaha Railway company at its freight house in Omaha Nebraska to bo sout to Not folk over its line of road and the said defendant re fused to loeoho the same nnd thus forced the shipment to bo sent oer tho Fremont Elkhorn As Missouri Valloy railway which should bo a competitor of this defendant Tenth That on the ith day of Febru ary 1DO0 another and like shipment of freight was tendered to thci said defend ant from Omaha to Norfolk Nebraska and the same was refused Eleventh That on the ith day of February 100 the said defendant re ceived and hnulod a shipment of first class freight from South Sioux City No braska to a town on its lino of road in Nebraska a distance of 115 miles for 12 cents and on tho same day cliaiged tho same shipper -Ml conts for hauling the same height seventy ono miles Twelfth That tho Chicago St Paul Minneapolis Omaha railway company owns and operates a lino ot railway and maintains and runs both passenger and freight trains daily botwoen Norfolk Nelnaska and Omaha Nebraska in both directions and regardless of the fact that tho morning passenger train of the said defendant bungs into Noi folk the Omaha mail and papers two hours ahead of any other tram running into this place and regaidless of the fact that tho same freight train which would carry freight to tho town of Hope provided always that thoio was any town there would and must run on into Norfolk and would bring the said freight in so that the saiiw could be deliciedto the shipper at 7 oclock in tho nioining said defendant absolutely refuses to biing freight to Norfolk fioin Omaha but foices the business to the Elkhoin and Union Pacific loads and Noifolk meichants niuit wait tho pleasure of tho Elkhorn peoplo and leceivo their freight about the middle of tho day and if the freight is received oer the Union Pact fie they are obliged to wait until the day after Thitteonth That this complainant be lieves and has leasni to behove that there has beon and now is an unlawful pooling contract agreement or under standing betwenn this defendant and tho Fremont Elkhorn As Missouri Valloy Railway coinpnny and tho Union Pacific whereby tho said loads dtvido the pro ceeds of tho business from Omaha to Norfolk and by maintaining theso con ditions at thoir Norfolk terminals tho said roads receive bonefits at tho expense of tho public which would not other wise accrue to thorn and in direct vio lation of section fi chapter lxxii Com piled Statutes of Nobraskn Fourteenth That by such unlawful agreement contract pool or understand ing this complainant is doprived of its natural advantages of competition and its short lino to the Missouri liver is of no advantage to it for tho reason that the rates are dictated by tho longest routo Fifteenth That this complainant is discriminated against by the said de fendant in that it demands aud receives more for tho carriage of freight from South Sioux City Nebraska to Noi folk Nobraska than it demands and re ceives for performing hko and corres pondining servico from South Sioux City to other towns equally or more dis tant as Hartuigtou and Wausa in this stato regardless of tho fact that tho shipment to Norfolk is along tho main lino of said defendants lino and that ill performing such sorvico to tho other towns mentioned such freight would bo diverted to branch lines of tho samo road Sixteenth That this complainant is discriminated ngaiust by the said do fondant in that it demands and receives moro for a liko sen ice from South Sioux Oity Nebraska to Norfolk than it do mauds or receives for a longer haul to towns in this stato much more distant than Norfolk Nebraska Seenteenth That tho defendant eiimiuatos against this complainant in that in connection w ith olliet roads it hauls height troin South Sioux Citv to points moio than double the distance to Norfolk and within the state of No biaska foi less than it demands aud u ceives ft om the sexeiitv one miles to Noi roll Eighteenth That the said dereudant disci iiiiiuates against yom complainant in that it hauls ft eight to a station on its line or toad 111 miles front South Sioux City for 17 cents and chaiges this complainant 12 cents for hauling the sumo freight seventy one miles to Noi folk Nebrasla Nineteenth That a late ot 12 cents Hist class for a haul of seventv one miles is unreasonable and excessive as compared with the mtes cliaiged by other reads in the stale of Nebiaska foi a like haul fi om Fremont Onialia or Lincoln to points seventy live miles dis taut f l om said points Twentieth Oily and Not tolk so that no undue piofciciu e or advantage shall be given to the ship pets of Florence llailiugloii or Wausa as computed with Noiiolk and that Noiiolk l ales be just and equitable as compared with other rates quoted Sixth That restitution be oideied to be niiide to the slttppets of Noiiolk as figured on a basis of disciiiniuations shown in favor of llaitington Florence and Wausa and lor such other relief as may be just and within the and jusisdn tion of your honoiablo boaid Tho complaint was taken up by see tions and testimony regarding each was taken The first complaint was in re gard to there being no published t at ill kept in it conspicuous placo and ready of access in tho depot at this place C 11 Johnson was the list witness sworn Ills testimony wont to show that more was no published tariil kept in tlio waiting room for tho convenience of tho public as at other dopots Tho rates w ore furnished by the agent or other employes when asked for but were l hen not readily secured Could got a tarrif sheet but no ordinary person could figure what tho rates to and from coitain points wore without consulting tho omployos oT tho road Tho tariff sheets wore kept in the ticket office Was a door leading into it but was labled No admittance This tesimony was not all Mr John sons story some of it being induced by cross questions from Mr White and Mr Free and tio same policy was put sued in regard to other witnesses F W 1 lineman local agent for the M As O road was sworn Ho testified that a taiill rate was posted in a con spicuous placo in the ticket office and was always ready to answer questions regarding freight intos giving tins duty a preference to any other business There was a door maikcd no admit auco but there were two others not fo marked and any one was readily ad mitted to tho ollico There were notices concerning tho tarifl posted in tho wait ing and baggigo rooms Tho rates were not posted in the waiting loom thoy were torn down and de
