sewerage system is as follows
Wo first start at the Northfork river
with 15 inch sower pipe which wlth the
grade wo havo has a carrying capacity
of 2300 gallons per minute When wo
got whero tho increased grado will por
mlt we roduco to 12 inch tiling this
main pipo to be located either on Nor
folk avenue or on Madison avenue run
ning to Thirteenth street From this
main pipo ou each aud every streot run
ning north aud south there will be later
als of 8 nnd 10 inch pipe whloh will pass
every property whore wanted
Our rato to oaoh subscriber will be
first for deod to opening 15 then from
such oponlng tho owner or agent may
havo anyono competont to lay sewer til
ing mako connections and extend to fix
tures but wo will guarantee that such
connections aud pipo shall not bo more
than 15 couts per foot complete After
such 15 for doed to connections aud 15
couts per foot from connection to llxturo
is paid thon tho rate of rentals will
rango from 150 per year to 3 per year
for ordinary residence depending on
amount of fixtures connected This is
what wo think to be an opportunity for
our oity since the rate to connect with
soworago is less than cost of an average
cess pool and yearly rental is less than
expense of maintaing cess pool aud clos
et vaults Wo feel that we must have
at least 200 or 800 subscribers before wo
would be justified in invosting so much
capital Wo do not believe you will
think this unfair or greedy on our part

from any aud all damages that arise
from constructing maintaining operat
ing and using said sewer and its con
nectious or latorals and nothing herein
contained shall bo construed as inter
fering with tho rights of any proporty
ownors to recovor from said W H Rish
uny damage resulting to private property
by reason of its nse and occupation of
said streots and alleys Tho said city
also reserves the right to take possession
of aud oontrol all sowers laid under the
provisions hereof at any tlmo it desires
by paying to said W H Rish a compen
sation equal to the actual value thereof
to be ascertained by arbitration
Section 0 The said W H Rish shall
be governed by the following rules and
regulations in the constrnotion and
maintenance of all sewers laid under
tho provisions hereof and by such other
rulos regulations or ordinances as may
be horoafter adopted or passed by the
said city
Rule 1 Treuohes In public streets or
alloys shall bo excavated so as to impede
public travel as little as possible Tho
crossings of gutters and all other ways
shall be loft in such shapo as to admit of
tho ready cscapo of tho water during
storms plunks shall nlways be provided
whero sidewalks or crossings are opened
so as to facilitate easy aud safe crossing
over trenches
Rule 2 Red lights shall bo kept
around all unfinished work at night and
sufficient barricades against acotdent
shall be placed around excavations at all
times
Rule 8 Work in public streets must
uot be unnecessarily delayed and whon
directed by the city mayor the number
of workmen shall be increased to hasten
the work to the extent the said mnyor
may deem necessary for public interest
Rule 4 Trenches in depths of six feet
or over and in all made or otherwise
treacherous soil or near large brick
buildings shall be properly braced and
the party excavating and his bondsmen
shall be liable for all damages arising by
reason of any neglect in this respect
Rule 5 Tho refilline of all trenches
shall be well and thorougly done in uni
form layers of not exceeding nine inches
aud tapped with a tamper of not less
than forty pounds weight or with pud
dled earth so as to replace all excavated
material and leave the surface in as good
condition as before the commencement
of the work and shall always be kept
and maintained by said W H Rish in
like good condition
Rule 6 All materials used iu the con
struction and maintenance of said sower
and its laterals connections and nil
parts thereof shall be thoroughly skill
fully aud properly constructed nnd the
same kept operated and maintained iu
a thoroughly sanitary manner and iu a
manner conducive to tho health safety
and welfare of tho patrons of said sewer
aud the public And thn city engineer
mayor ond members of the council and
tho ohief of police shall have access nt
all times to any building connected with
any sewer laid under this ordinance to
properly inspect the same
Section 7 ThesnidW H Rish or
his assigns shall begin the construction
and operation of said sewer within one
year from the taking effect of this ordi
nance or tho rights and privileges here
in granted shall cease and the privileges
horeby conferred and granted to said W
H Rish shall be for a period of twenty
years from tho taking effect of this ordi
uauce subject to tho provisions of sec
tion fivo of this ordinance provided
however that if said W H Rish or his
assigns shall fail to construct operate
and maintain said sewer its laterals
connections and all parts thereof in the
manner herein provided or shall fail to
comply with the rules aud regulat ons
or any of them heroin contained or
shall fail to comply with all the rules
regulations and ordinances hereafter on
aqted by the couuoil of said city concern
ing said sewerage system or sewers the
said city shall havo the right nnd the
same is hereby reserved to declare the
rights and privileges herein conferred
upon and granted to said W H Rish
forfeited aud at nn end and may abate
and cause the said sowerogo to bo re
moved nt the cost and expense of said
W H Rish
Section 8 Any person or persons
owning or controlling proporty abutting
any of the public alleys covered by this
ordiunnco nnd within the limits hereto
fore providod shall have the right to
connect with the main sewer or any of
its laterals contemplated by this ordi
nance provided that if at the time they
desire to make such connections said
W H Rish has no laterals constructed
on the line of such alley and does not
deem it expedient or profitable to con
struct the same at his own expense
then and in suoh case the party or
parties desiring to make connection
shall give to the said W H Rish a good
and sufficient guarantee that they will
pay tho actual cost incurred by the said
W H Rish in laying and constructing
a lateral sewer from the said main to a
point in said alley where connection is
desired so be made As soon as the sewer
shall be completed then it shall become
the duty of said W H Rish to construct
such lateral sewer without unnecessary
delay and to place the amount paid by
said party or parties to their credit On
sewerage account ouly and to be ex
hausted by sewer charges or rental only
when such payment above provided
shall have been made then such party
or parties shall have full right to counect
with suoh sewer under and in conform
ity with the general rules of said W H
Rish governing similar connections

Section 9 All persons owning prop
orty contiguous to any line of sewer or
lateral constructed under the provisions
of this ordinance shall have tho right to
connoct with the samo iu conformity
with all reasonable rules aud regulations
adopted by said W H Rish governing
tho samo
Section 10 If nny person having
connection with any sower or lateral
sower constructed by said W Hi Rish
under tho provisions of this ordinance
shall fail to comply with any reasonable
rule or said W H Rish ns to proper use
or bare of panto or Jhall fall for tho
period of thirty dny4 to pay tho regular
charge or rental made by said W H
Rish for uso or rental of same then and
In such case tho said Wi H Rish shall
havo tho right to cut off all connection
with such sower and shall be under
no obligation to rennw suoh connection
unless the party shall give a good mid
sufficient bond running to the Bald W
H Rish against any loss of damage oc
casioned by such conueotton to said W
H Rish and to oovor rental of same
Section ll That all sewers and lat
erals laid under tho provisions of the
ordinance be laid in -the alleys when
possible to do so but where not possible
then and in such coses the sewer pipes
to be laid on the east and south sides of
tho streot or on onnosite side of street
from water main Said pipes to be laid
in center of alleys aud 20 feet from east
and south side of streets
Section 13 That whenever the city
of Norfolk desires to make any connec
tion with tho sower owned by the said
W If Rish it shall be permitted to do
so at its own expense and there shall be
no charge made for the use of said sewer
system when such use is for tho benefit
of tho city but said city shall keep its
own connection and extensions in repair
without expense to the said W H Rish
Section 13 This ordinance shall take
effect nnd bo in force from and after its
passage approval aud publication ac
cording to law
