The law makes ifc ray duty to
give you in special charge Chapter
21 , of Cobbey's annotated statutes
pertaining to gambling. Also ,
chapter 32 of said statute which is
the chapter concerning the liquor
laws of the state. Section 2361 is
also a section which it is ray duty
to call your attention to. This
pertains to the sale of tobacco ,
cigarettes , cigarette paper , etc ,
to minors under eighteen years of

You will carefully consider all
of these matters and sections to
which I have called your attention ,
and ascertain , if you can , whether
any of these sections are being
violated or have bee'n violated
within your county within the
statute of limitations.
I might -a.y in connection with
this that you h-ive in your special
charge the entire criminal code ,
and while it is my special duty to
call your attention to these par
ticular sections , and to give them
to you specifically , yet , this in no
wise excludes the balance of the
criminal code from your consider
ation.
You are advised that within the
last four months tin extraordinary
condition of affairs has arisen in
this county. In the summer of
1911 , one Charles Sellers .was
murdered in the vicinity of Cody.
Five people were arrested charged
with commission of this murder.
At the October session of this
court , four of them plead guilty
to the crime of murder in the second
end degree and were sentenced by
tie court to imprisonment for
life. One was not arraigned , and
the action against her was dis
missed. Shortly after this session
of court adjourned , dis-satisfaction
wish the disposition of these cases
became apparent in the neighbor
hood of Cody , and some of the
people there made charges which
involved the integrity of the court
and all of its officers. Charges
were raade and reports were circu
lated , that other persons who had
not been arrested , were implicated
in the murder of Sellers ; that large
suus of money had been raised by
thess interested parties and that
all the officers of the court ; the
judge , the clerk , the sheriff , the
county attorney , had all been
bribed to do something , which has
never been disclosed to my know
ledge.
Novv , Gentlemen of the .Grand
Jury : It is my wish that in tak
ing up this matter that you inves
tigate every feature of it. First ,
you are directed to ascertain
whether or not any other person
or persons than those convicted
were in any way implicated in , or
had anything to do with the mur
der of Charles Sellers. You will
go into this matter with great
care. Summon every person who
is known to have any information
concerning the transaction , or who
it has been reported has any in
formation cencerning the matter.
Interrogate all these parties with
great care , in order that you may
discover whether or not any per
son or persons was implicated in
this murder in order that such
person or persons may be put up
on tria' ' and brought to justice.
In the next place you must make
diligent inquiry as to whether or
no. there was any corruption , or
dishonesty , or malfeasance in office
in any way connected with the dis
position of these cases. If you find
from the evidence that any money
was used for the purpose of cor
rupting or bribing or influencing
the judge of this court to do any
fict whatever , or to refrain from do-
in what he ought to have done ,
then it will be your duty to prompt
ly return an indictment against
him. And this applies equally to
Lhe clerk , the sheriff , the county
ittorney or any other offi-er in any
way connected with this court.
These charges of corrupuon have
been published in newspapers and
3therwise , in Cherry coun y. I am
infoimed that such charges have
been made in handbills or circulars ,
nd that suob handbills or circulars
have been circul ated amongst the
people. If you find from the evi
dence there was no foundation for
such reports ; if you find from the
evidence that the officers of this
court in all of their acts in cc * ; ruc
tion with that case , were & . ing
honestly , and using their best .r'dg- '
ment in the interest of the public
good ; and if you find that such re
ports published in newspapers and
pamphlets were false , then this
court and its officers are entitled to
the protection given to them by
law , and it will be your duty to in
dict any person p ublishing such
false matters. And you are further
advised , that the distribution of a
circular containing false statements ,
which , if true would impute a crime
to any individual , is as much a pub
lication as if the distributor were
the editor and publisher of a news
paper which published the article.
And if you find any person has been
guilty of this offense , then it will be
your duty to return an indictment
against them for criminal libel.
I am not one of those who believe
that courts are above or beyond
criticism , and that their acts ought
not to be criticised by the public
when their acts are wrong. I be
lieve a judge , or any other officer
constituting your district are pub
lic servants , employed by the pub
lic to do public business , and if they
do wrong they ought to be criticised ;
and if they do any criminal acts , or
are guilty of corruption , they ought
to be impeached or otherwise re
moved from office. But if they per
form their duly honestly , and use
their best intelligence and their best
efforts to subserve the public good ,
then they ought to be protected by
the legal machinery provided by
law , which in this case is the grand
jury. Criticism must be based up
on truth ; if based upon falsehood
it becomes libel and is a crime. In
all of your investigations , gentle
men , concerning this matter , be
dilligent in seeking the truth , asd
when you have found the truth , do
not hesitate in any instate to re
turn indictments when they ought
to be returned , or to condemn un
reservedly any person whose acts
have been such that they merit con
demnation at your hands , even
though an indictment can not be
returned against them.
In connection with this matter ,
gentlemen , before you adjourn , I
want to request at your hands a full
and complete report upon
every phase of this case. I want
you to examine each report which
has been set afloat ; each charge
which has been made by any citizen
of your county , and in your report
state whether you fiud such charge
true or false. One thing was
charged by a newspaper , and that
was , that at th $ last session of this
court , the court held a "star cham
ber" session concerning a part of
the business then before it.
I want you to ascertain the facts
with reference to this , and state in
you report whether that is true or
false. And in this way take up
each and every report which has
been circulated which reflects upon
persons whether connected with the
court or not you find such report
true or false.
You are advised that during your
deliberations you will have my
hearty co-oporation in every particu
lar. If you desire it , I will gladly
appear before your body as a wit
ness under oatb , the same as any
other witness brought before you ,
will gladly give any and all in
formation which I have concerning
any matter about which you may
see fit to inquire.
In Cherry county , during the
early days of its settlement , when
many of its citizens whiled away
hours by indulging in a game of
poker , I am advised that the rule
3oncerning that game , required
that the parties keep the cards on
top of the table. And , gentlemen ,
in this investigation I want to in
voke this old rule , and trust that
you will see to it that no person in
ny way interested , directly or in-
lirectly , will be permitted to hold
