Judge . Westover Called.

Last Friday near the close of i .
district court Judge Westover
called the editor to the stand to
explain the editorial entitled
.
'District Court" on Dec. 16.
We print below a copy of his
letter , in response : to which we
wrote up an explanation and sub-
mitted it to the court and -which
he : required us to read in coqrfc.

Judge Westover didn't appear
very willing to receive our ex-
. planation as to our not referring
tp him nor intending to criticise
him and after considerable - ques- !
tioning in addition .to our offered
article of about 20 pages , asked if
we would be willing to publish a
statement this week , saying that
we didn't mean him."T e'\.e told
it'elsewhere in this paper. We
offered to print the whole twenty
pages if he wished it but he didn't.

Found Dead.
; ; Ernest Runs With , a Sioux In-
dian , was found dead at the / second
crossing of the railroad east of
the ; depot Tuesday about 2 o'clock.
He was frozen stiff and had
bruises about the head and limbs
and his clothing bore evidence of
having probably been struck by
the passenger train which came in
: frQm the east last night , or the
one arriving ' 1 at three o'clock Tues-
. day morning :
. . . . ' , " When . found he was lying . near
.he ' track in the..snow and evident-
l.v was instantly killed. \ His pants
were pushed up toward his'knees
and his legs bare from his' knees
dowu to shoes. An overshoe was
on the right foot and a .moccasin i
only on the left. Looked like he
had been dragged . few feet or
pushed along the ground . . . feet

Ernest ; Euns With and his wife
came down , from Kilgore Monday
and spent the day shopping in
t own. Towards . \ ' ning Ernest
elea.around some with another
Indian whom he" knew and they
took several drinks together. His
wife was getting her things ready
for the 7:30 : train and upon cora-

ing back to the hotel learned that
he had gone , and as.she was unable
to find him , and thinking he had
tnken some train out of town , she
went on the early . evening train to
Kilgore. Reaching there she tele-
.
phoned back for him "and came '
down Tue'sday morning when she
learned no one bad-seen him and
began a search which resulted in
finding him as above stated by one
of . ' thfc section men.

-It is supposed that he may have
become blinded' } by the snowstorm
and failed to see the train ap
proaching or that he was trying
to get aboard while the train was

moving.
