state requiring. parents tp send
their children to , school. The law
hasbeen overlooked and many
children -have failed to attend
D ? school according to its provision
! in the past. Parents are respon
! sible for this but officers of the
l community are guilty of contrib-
utory delinquency and when their
r duty-is neglected any person who
l may know of the violation of the
1 law is .also guilty of contributory
delinquency. % This law should be-
I enforced and let's begin . .athome. .
I We see children : frequently - .out
: of school and we wonder what for.
i Those children are most likely to
I grow up and become county wards
or become vagabonds , theives or
at the best dependent upon . the
the community for support and
assistance through life. ' Of course , i
not all uneducated persons are i
thus. . We know of many who are !
good honest people but they I
would have'been ; much better off I
had they Attended school when
young and received only a little
education. Judge Quigley : issued

And now on the 20th day ' of
November , 1909 , this cause came
on for hearing and comes . now the
said John M. Tucker , , petitioner
and'comes : also the ! said .Thomas
Dowell in person into ; operi court
.md ; the cause comi ng on , for hear- '
ing on the petition , and the court
hearing the evidence finds that the
said Cyrus Dowell h i a male child
ten years ef age ; that the said
'Byron Dowell is a male child
eight years of age ; that Eva D .w-
ell ) ) is a female child six years of
ago ; that Retty Dowell is a female
child five years of age and that
Nettie Dowell is a female child
five years of age ; and that , the said
Thomas Dowell is able to send the
aid minor children to school.
The court further finds that the
statements and allegations in said
ppfition are true.
The order of the court therefore
is that the said Cyrus , Dowell ,
Byron Dowell. Eva Dowell , Retty
Dowell and Nettie Dowell be at
once taken by the said Thomas
Dowell and his wife Marietta
Dowell or either of them or some
person in their employ to some
school in the state of Nebraska
that maintains at least six months I
school I in the year in said state , ,
and there had ! to attend during
said school I term t ( .and the said

the name of the principal teacher

courts and. all the other courts in
succession have more power in
ihiis , our country , than congress
and the president. They can as
, promptly void any law or order
that comes before them as they
are brought ; or they can declare
. , them constitutional and decide a
case accordingly only to be . an-
nulled . by some higher court , and
"there you are. " . . . .

Ed Bell shot and . killed Oscar
McArthur.
They were working together ,
rooming together , sleeping to-
gether down at the railroad camp
near the river. They lived t gethI I
er for three months or more. I
There was troubje between them.
One or the other- ' or both were to
blame for . that trouble. They
quarreled and fought over some
trivial matter because of wrong
living-either in one or the other ,
perhaps bOth. One was aggress !
ive i , and perhaps the other was
stubborn willful I and selfish. Per-
haps both would answer this de-
scription to some extent. .

One man lies dead. .
The other is in jail. '
Was there a provocation that
caused McArthur to attempt mur-
der for his rights ?
If there was , then the'ac -
cused should be held for murder
though the courts may clear 'him
through failure to go into the pre-
vious circumstances Which led to
the attack and to the shooting , but
the man whose hands are stained
with ' the , blood of ,4Uscar.- / Mc- :
Arthur l4 jrtiilty \ of & rder. ' He
fired the ' - fatal shot which encjed . a
life and if there .was a : provoca
tion for the attack he is not clear
who then shoots as a pretext of
saving his own life.
A thorhugh investigation is none
too much tot ask in such a case. A
crime has been committed. The
man who attacked felt : wronged
and sought redress. His'methods
may not have the approval of law-
abiding citizens but he was mur ' -
dered for taking the wrong course
by the man with whom -he quar-
reled.
One life is gone. '
It may not be too much ' to , ask
that suitable punishment be inflict =
ed upon the other. It is meet that
atonement'and ' expiation be suffer-
pd for his crime. He may p-
parently have shot in self defense ,
but behind it all there was some
thing else. Let the law take it i < s
course. The citizen of Valentine
will suffer through neglect to iL-
flict punishment for crime. Too
often has this occurred , and until
every man who commits a murder
is punished the town will continue I
to receive the wild and wooly p le- ,
ment with extended arms.
We know not the past r cord
nor life of either party but both
were apparently armed to kill
Their thoughts must have been I
upon murder if they thought at
all. Again ! we repeat let the law
take itscourse and stop ! this crime.
