Co. , for the appraisal and condemna tion of certain school lands be longing to the state of NVbnibka proposed to be taken by said rail road company for railroad pur poses. Present A. E. Morris and James Mone. Board immediately proceeded to view and appraUe said lands set forth in said application of the C. & ft.V. . R. R. Co. as follows , to- wit : Part of the swsw , sec. 1C , tp. 33 , r. 27 , containing 5.08 acres the value , thereof assessed at 87 per acre , amounting in the ag gregate to § iO.(50 ( ; part of the n\v- sw , sec. The commissioners designated a new precinct in Cherry county to be known as Russell precinct and comprising the following territory to-wit : Commencing at the north ? east corner qf section , i , tp. 30 , r. 38 , running thence west to the northwest corner of sec. 6 , tp. 30 , r. 40 , thence south to the south- west'corner of sec. 31 , tp. 28 , r. 40 , thence east to the southeast corner of sec. 30 , tp. 28 , r. 38 , thence north to the point of be ginning , all the territory included in the above described meets and bounds being the territory desig nated as said Kussell precinct , and the voting place in said precinct designated at the Hewett & Morey ranch , said precinct being granted as per the petition of Wra. Enlow et al. al.As As per the petition of D. A. Hancock ct al the territory in cluded in the south half of towns - s lip 3f , range 25 was taken from Sparks precinct and annexed to Wood lake precinct. Matter of the affidavit , of A. Procunier for a refund of real es tate taxes paid by him on a part of lots 3 , 4 , 5 and 0 in block 1 , Mer- riman village , for the years 190. > and 1906 , said taxes having been paid by him under protest for the reason that the assessed valuation of said property was not lowered when said property deteriorated in value caused by fire , taken and a refund ordered granted him of S2L.H9. Refund of $3UO 98 made to R. M. Faddis & Co. , on taxes * -paid by them in Kennedy precinct for the year 1908 , on personal prop erty , same having been -eroneous- ly assessed. Matter of the application for a refund of $3 80 on real estate tax es paid byV. . R. White on lot 6 , block 6 , Merriman village , reject ed for the reason that said taxes not paid under protest. We miss Miss Anna Newman from our midst , she having the care of her little sick brother at a southern hospital. Mrs. Cook's school is nearly finished and has been a glorious success.
