Stock tanks made in all sizes Valentine , - Nebraska Read the Advertisements , W TRIAL Sentences were passed in federal court Monday morning on' Bartlett Richards , Will Comstock , Charles C. Jamieson and Aquilla Triplett , who were convicted of conspiracy to defraud the government in lands. The sentences are : Richards , fine of § 1,500 and one year in Douglas county jail. Comstock , fine of 81,500 and one year in Douglas county jail. Jamieson , fine of § 500 and eight months in Douglas county jail. Triplett , fine of § 500 and eight months in Douglas county jail. Immediately after sentence had been passed , the cattlemen gave notice of appeal. They will go to the circuit court of appeals on a petition in error. Each gave bond for § 5,000. In overruling their application for a new trial Judge W. H. Hunger said that the evidence in the case , taken as a whole , justified the jury in returning a verdict of guilty. After overruling the motion for a new trial Judge Munger tilted back in his chair , paused , then asked the cattlemen if they had anything to say why sentence should not be passed upon them. Comstock spoke in their behalf and thus outlined their position : "In these land transactions we were acting under and by advice of our attorney , who not only stands high in his profession , but possibly , by reason of his fami liarity with the practices and cus toms of the land office , was more capable to give an opinion on the United States land laws than any man in the state. "His advice was that we were not only clearly within our legal rights , but also our moral right. " He said we were supported by rulings which prevailed in the in terior department for the past 30 years. This opinion of his was corroborated by the interior de partment itself in their action in the Pear man case. "In this case an investigation was made by a special agent of the government in an affidavit ob tained , showing the exact parallel condition to this case in which we were recently tried. The interior department , acting , as I under stood at the time , under the spec ial direction of Secretary Hitch cock , immediately ordered a pat ent issued for the land. "Relying upon this opinion from two different sources , I felt that I was doing nothing but what was clearly within my rights for cer tainly the farthest thot from my mind was that in any of these trans actions I was disobeying the laws of ray country. For we feel that we have a right to depend upon our legal advisers as well as the interior department itself. It has been my desire to so live that when my allotted time should have run people would say that I al ways tried to be fair and just , and tried to do what was right. "You , the judge of this court , in carrying out your duty , cannot inflict a punishment that will cause me to feel more deeply this humil iation humiliation brought about without any intention on my part of disobeying any law. I would especially ask for your leniency for one of the defendants , Mr. Jamieson. He was not a free agent in these matters simply a subordinate who believed he was doing right , knowing and re lying upon the opinion I have out lined. No man of my acquaint ance has a greater sense of honor and integrity than has he. " Afterward A. W. He averred that Richards and Comstock had never intentionally violated the law of their country. Mr. Crites said : "If practices , such as those for which men have been convicted had been condemned by the de partment of the interior years ago , instead of having been approved by the department , such a case as this would not have been possible. " -JIISTOKX OF THE CASE. In the prosecution of Richards and Comstock the government centered its forces. They are con sidered the wealthiest ranchmen of Nebraska , with an inclosure of a half million of acres in Cherry and Sheridan counties. A year ago they pleaded guilty to the indictment charging them with unlawfully enclosing the pub lic domain. They were sentenced to six hours in the custody of the United States marshal and were given a nominal fine. Later the United States marshal was peremptorily dismissed for failure to keep the cattlemen in his actual custody instead of at an Omaha club with an attorney as deputy and District Attorney Baxter was discharged for per functory prosecution. " \Vith the assistance of twenty secret service men , L. C. Wheel er , agent in charge , went into the field to get fresh evidence. This resulted in an indictment charg ing the cattlemen with conspiracy to defraud the government of the title and use of public land. Subor nation of perjury and conspiracy to suborn perjury were other charges of the indictment. After a vigorous prosecution by Special District Attorney Rush and District Attorney Goss , the jury brought in a verdict of guilty. The motion for a new trial was argued last Friday.
