Even the sentiment is gaining in the minds of the people that no act of the legislature is a law until it has the ap proval of the courts This , if true , makes the legislature useless. Not only sobut it destroys one of the co-ordinate branches of state government. The nullification of so many laws by our courts , I am led to believe , is not oc casioned by the intention of the court to usurp the authority of the legislature , but more on account of the inadequacy of our constitution. This was adopted at a time when our state was new , its resources undeveloped and its settle ment meager and sparsely distributed. In my opinion , should you make pro visions for the calling of a constitution al convention , such action would meet he hearty * pproval of the people. The constitution places the obligation upon the legislature to apportion the representatives and senators according o population , determined either upon .he census of the United States or of Nebraska. It requires that each ten years , beginning with the year 1885 , a census of the people shall be made. The present apportionment is mani festly unjust to the western half of our state. With more than oue-seyenth of of the population , it has only five rep resentatives out of 100 , and less than three senators of the thirty-three in our senate. As an act of justice long de layed , I recommend you take up the work of reapportionment , which the legislature of 1895 should have made , and give to our western people the rep resentation to which they are entitled The passage of a law against the issuance of any free passes , except to employes of the railways , and making the one accepting a Iree pass particeps crimiuis , both alike subject to penalties attached adequate for its enforcement , with a reduction in passenger rates equivalent to the profits derived by the abolishment of passes , would be alike just to the railways and the traveling public I am , individually , and the party of which I am a member is opposed abso lutely , to the protective policy of taxing one industry for the upbuilding of another ; but my party is not now , nor has it ever been at any time , either in theory or practice , in favor of repudi ation in the smallest degree. The legis lature having made a bad bargain for the state , should not seek to be relieved of that bargain by a subterfuge or upon technicalities. The sugar bounty act of 1805 has created a number of just claims against the state which are now in the hands of the farmers who grew sugar beets. I recommend that you make provision for the payment of all claims arising from the act of 1895 which may be presented by the actual growers of sugar beets in the state * whenever such claims are properly at tested by certificates of weights from the proper authorities. I would especial ! v ask your earnest consideration of some plan of equaliza tion of assessments iii all parts of the state. Under our present plan the same kind of property varies in valu ation at different counties from 10 to 30 per cent. This is grossly unfair , Lnt fonts remedy no means at present exist. There is no broader fie'd for the exercise of true statesmanship than in the creation of a just and equitable sys tem of revenue and taxation. It is a matter that affects every citizen indi vidually and the material interests of the state. Gov i'oynter's Message. F. B. Ilubbard of Weeping Water , Neb. , came in today from Rushville with a shipment of cattle. Mr. Hub- bard has been in Sheridan county for several months and expects to make his home there in the near future. lie is very much impres ed with north west Nebraska as a cattle raising and grazing district and says that the herds there this winter are in prime condition. There are lots of cattle of all kinds throughout that locality and they are all fat. The cattle run on the open range throughout the year , and while they usually have an abundance of ha } ' it hardly ever becomes necessary to feed it to the stock. * Mr. Ilubbard will turn his entire attention to stock rais ing in the future and expects to estab lish a herd in the sandhills the coming summer. Journal-Stockman. The cold weather and snows in North ern New Mexico and Texas have caused considerable suffering and loss among cattle and sheep. The direct losses have not been heavy as yet , and should the weather turn warm soon and no more cold spells follow , the early grass which will result will help out , but stockmen are very uneasy and will been on the anxious seat until the weather shows decided symptoms of becoming decent. Denver Stockman. Jandt , the Crawford stockman , has a fine herd of Georga milch cows. One especially fine cow gives a heavy yield a pint a day. Jandt took a sample down to the creamery to test its butter fat After a week's work , the sports of Crawford declare , no trace of more than a second grade cottonseed oleo margarine can be found. Ohadron News. Gallop. Measles are quite raging in this vicinity. J B. Bones had seven down with them at one time Mr. Warren four ; Mr. Mann seven ; Mr. Price two ; Mr. .Stillborn five ; Mr. Cady six. Sones has added quite an improvement to his homestead by putting up a now windmill which pleases th family and stock overflow- ingly. His wife is so well pleased to think he took the pleasure to run the water in her kitchen that she wears a smile all the time. I. , W. Lee , the Itoston correspon dent of the Chicago Drovers Journa says : The value of the animals and animal prod nets exported from America luring the year 1898 was nearly § 200- , 000.000. Twenty years ago tne person who would have predicted such a trade svould have been adjudged insane. IMie shippers back in the 70's were satlj isfiedto , send out a few barrels of pork and a few hundred sides of bacon and liams. They made some experiments in fresh beef and live cattle shipments , but the results were very unsatisfactory ind no one could be found who even : lreamed that the business would ever reach the ' present position. Twenty years ago live cattle could not be ex ported because the steamers were not properly fitted for the trade. Fresh beef could not be successfully canned because there was no refrigerator service in vogue at that time. Now live cattle can be landed in England in is good , and in some instances better condition than they were leaving the farms in this countrv. The news reaches the Standard this morning , that a murder was committed in the vicinity of Porcupine , S. D. , on luesday night of this week. The vic tim was an Indian woman The body \vas found on the ice in Porcupine reek. and apparently the murderer i bad attempted to put it into a hole and ! under the ice , but did not succeed. A j small child was found near by , almost j frozen to death. As yet no arrests ' nave buen made.
