Occupation (Continued from Page 1) a provision in Section 3 that the tax imposed by ordinance 953 does not apply to non-profit org anizations. "This provision merely elimi nates these organizations from the requirement that they pay occupation tax under Ordin-I nance 953 and in my opinion it cannot be construed to repeal any portion of Ordinance 885. "The second request is that you (the Council) repeal all or-; amances aeanng with club lic enses. The reason given Is that It is illegal to hold a meeting or otherwise occupy the club on Sunday. "Nowhere in anv Cit.v Ordin ance is there any provision that!! it is unlawful to be in a licens ed establishment on Sunday. Both the City Ordinance and the State Law prohibijt sales on j Sunday of alcoholic liquors but do not make It illegal to be in the premises. "Your attention Is called to the fact that a repeal of all or dinances dealing with clubs would legalize the sale of beer on Sunday and would eliminate; any control over the presence of minors In such establishments. All violations would have to be prosecuted under State Laws and there would be absolutely no local control over such estab lishments, except by enforce ment of State " i The city attorney's opinion noted that he was not trying to' suggest Council policy but onlyj trying to answer questions rais ed after receipt of the clubs' letter.
