Said sanitary sewer system and sewage treatment pond shall be constructed in accordance with the plans and specifications prepared by Price, Johnson & Erickson, special Engineers for the Village of Murdock, Ne braska. Reference is hereby made to the said plans and specifications which plans, speci fications and estimate of cost are hereby approved and adopt ed and by reference made a part hereof. The Engineer's estimate of costs of such improvements is $42,182. 7. To pay the coat of the im provements herein provided for the Chairman and Board of Trustees will, after .such im provements have been completed and accepted, cause to be Issued negotiable bonds of the Village of Murdock to be known as "Sewer Bonds". The lateral I sewers and the main sewer to the extent that they specially serve and specially benefit the abutting property are declared to be local improvements and the cost thereof to the extent of the special benefits accru ing to the abutting property from the construction of the said sewers shall be assessed on such abutting property as pro vided by law. All such special assessments shall, when collect ed, be set aside and constitute a sinking fund for the payment of the interest and principal of said bonds; and there shall be levied annually upon all taxable property in the Village a tax which, together with such sinking fund derived from said special assessments, shall be sufficient to meet payments of ' Interest and principal of the bonds as the same become due; said tax shall be known as the "Sewer Tax" and shall be pay able annually in money. Except as hereinabove provided all of said Improvements are declared to be general public improve ments and not local improve ments and for the benefit of all property In the Village. All of said Improvements are found and declared to be necessary and proper to furnish a sanitary sewer system for said Village. BE IT FURTHER RESOLVED that the Clerk be and hereby is instructedd to cause notice of the pendency of said resolution and the time and place at w hich said resolution shall be consid ered for passage and objections heard thereto by causing said notice to be published in the Plattsmouth Journal, a news paper published In Cass County and 6f general circulation in the Village of Murdock,. in two suc sivc publications, the Inst publi cation being not less than five (5 1 days nor more than two (2) weeks prior to the 2nd clay of August, 1957 and also by posting the notice for the same length of time in three (3.) conspicuous places in said Village, two of which shall be the Clerk's office and the Post Office. The said notice shall contain the entire wording of the resolution. At said meeting the Chairman and Board of Trustees will hear all objections to the passage of said resolution and the owners of property which may become subject to special assessments for the proposed improvements may appear and make objection to the proposed improvements and if a petition opposing the resolution, signed by the prop erty owners, represents a ma jority of the front footage which would be subject for the assess ment for the cost of any lateral sewer in the proposed sewer dis trict be filed with the Village Clerk within three (3i days be fore the date of the meeting for hearing on such resolution, the said lateral sewer shall be eliminated from the proposed Improvement and the resolution amended to show the same.
