March 22, 1956 LEGAL NOTICES OFFICIAL PUBLICATION NOTICE OF PROPOSED RES OLUTION OF NECESSITY FOR CONSTRUCTION OF SANITARY SEWER SYSTEM IN SANITARY SEWER DISTRICTS NUMBER 1, ; 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16. Notice is hereby given that at a meeting of the Village Board of the Village of Elmwood, Ne braska, held on the 5th day of March, 1956, there was intro . duced and placed on file the Resolution of Necessity herein after set forth, which resolution will be considered for passage by the Village Board at a meeting to be held at the Community Building in said Village on the 5th day of April, 1956, at 7:30 o'clock P. M., Central Standard Time, at which time and place the owners of property subject to assessment for the cost of the improvement contemplated by said resolution may appear and make objections, if any they have, to the contemplated im provement and the 1 passage of said resolution, at which time said resolution may be amended and passed or passed as pro posed, said resolution being as follows: RESOLUTION OF NECESSITY BE IT RESOLVED by the Vil lage Board of the Village of Elmwood, Nebraska: Section 1. That the Village Board of the Village of Elm wood, Nebraska, having fully in vestigated and consideTed the sanitary conditions of said Vil lage, and being fully advised in the premises thereof, and hav ing duly considered the neces sity of correcting and improv ing such conditions within the Village of Elmwood, Nebraska, hereby find and declare it ad- visable and necessary to pass this resolution and to build a sanitary sewer system in Sani tary Sewer District Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16 consisting of ,main sewers and lateral sewers and sewage treatment plant as here inafter provided. Section 2. Sanitary Sewers shall be known and hereinafter designated as "Sanitary Sewer Districts Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16", said sanitary sewer system shall be constructed in accord ance with the plans and specifi cations prepared by Harold Hos kins & Associates, Special Engi neers, for the Village of Elm wood, Nebraska. Reference is hereby made to said plans and specifications which were filed in the office of the Village Clerk on the 5th day of March, 1956, and have been approved by the Village Board of said Village. Section 3. That said sanitary system in Sanitary Sewer Dis tricts No. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16, shall be constructed of cast iron pipe, vitrified clay sewer pipe, or Portland cement sewer pipe, and . any other material deemed suit able. In advertising for bids, bids shall be asked for. on cast iron pipe and on both kinds of sewer pipe. Section 4. That said sanitary sewer system, consisting of main sewers, lateral sewers and sew age treatment plant as herein after provided, shall be con structed in said Village and the location terminal points, and size of sewers constituting said sewer system shall be as follows to-wit: SANITARY SEWER DISTRICT NO. 1 An 8" main sewer in 7th Street from the sewage treatment plant to B Street. An 8" main sewer in B Street from 6th Street to 5th Street. An 8" main sewer in A Street from 5th Street to the alley between 3rd and 4th Street. r An 8" main sewer in the alley between 3rd and 4th Street from A Street to C ! Street. An 8" main sewer in C Street from the alley be tween 3rd and 4th Street to 3rd Street. An 8" main sewer in 3rd Street from C Street to D Street. An 8" main sewer in D Street from 3rd Street to West Street. The kind of sewers proposed to be constructed shall be sanitary sewers and a plat showing the boundaries of San itary Sewer-Districts NumDer i, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16 herein proposed to be constructed together with the specifications therefor is now on file with the Village Clerk and is by reference made a part here of. Section 6 . To pay the cost of said sanitary sewer system the Village shall after the improve ments have been completed and accepted, issue its negotiable bonds, known as "Sewer Bonds" for- Sanitary. Sewer Districts Number 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16. The Village shall cause to be levied and collected annually upon all the taxable property in the Vil lage a tax in an, amount suffi cient to pay the interest on said bonds . and also . to provide a sinking fund for the principal of said bonds as the same may be come due. " Section 7. The Engineer's es timate of cost of the proposed construction and all other ex pense incidental thereto is $77, 700.00. ..... , r Section 8. AND BE IT FUR THER RESOLVED, that the Vil lage . Board of the . Village of Elmwood, Nebraska, meet at 7:30 o'clock P. M., Central Standard Time on the 5th day of April, 1956, in the Community Build ing of said. Village for the pur pose of considering objections to the passage of this Resolution and the making of this improve ment, at which, meeting this Resolution may, be amended and passed, or passed, a& proposed. Section 9. AND BE IT. FUR THER RESOLVED, that the Clerk be and -he -is hereby in structed to cause notice of the pendency of this Resolution and the time and place at which said Resolution will be considered for passage and objections heard thereto to be by posting m three conspicuous places in said Vil- age, two of which shall be the office of the Village Clerk and the United States Post Office in said Village, and to be pub- lshed in two publications of the Plattsmouth Journal, a legal newspaper of general circula tion in the Village of Elmwood, Nebraska, which publications and posted notices shall contain the entire wording of the fore going resolution and the last publication shall . be not less than five days nor more than two weeks prior to the time set for such consideration; and at said meeting the Village Board will hear objections to the pas sage of said resolution and own ers of property which may be come subject to assessments for the contemplated improvement may appear and make objec tions to the proposed improve ment and, if a petition opposing tne resolution, signed by prop erty owners representing a ma jority of the front footage which may be subject to assessment for the cost in any proposed lateral sewer district, be filed with the Clerk within three days before the date of the meeting for the hearing on such resolu tion such resolution shall not be passed.
