Just a century ago this week, Francis Burt, who had recently been appointed governor of the far-off Territory of Nebraska by President Franklin Pierce, was preparing to leave his home in Pendleton. South Carolina, to make his way to his new post beyond the Missouri. A journey from South Carolina to Nebraska was no light under taking in 1854. Armistead Burt, son of the Governor, accompa nied his father on that fateful journey, and in later years wrote this of it: "First, in regard to the modes of travel.' From Pendleton to Athens, Georgia, in his own con veyance; thence to Nashville, Tennessee, by rail from Nash ville to Louisville, Kentucky, by stagecoach; by rail to Chicago, ; Illinois, and on to Alton; thence to St. Louis by boat; then up the river by boat to St. Joseph, the river being so low that the boat could not go higher, and the Governor, being very anxious to reach the end of the journey, hired a hack and travelled in it to Nebraska City, which then contained one house, where he lodged one night. The next morning he hired a two horse wagon from the only citizen of Tlll i, : . l t uii. the same evening." The long, hard journey com pletely exhausted Governor Burt. He was so ill when he reached St. Louis that he was obliged to stop over there several days, con fined to his bed. By the time he reached Bellevue, October 7, he had grown even worse, and he went to bed immediately in ; the Mission House of the Rev- erend William Hamilton. As is , well known, Governor Burt never arose from that bed. He died October 18th, two days aft er the oath of office had been administered at his bedside by Chief Justice Fenner Ferguson. From all available information it appears that Governor Burt had begun the journey to Ne braska with high hope and with the intention ot making his day of September, 1954, at the hour of 2:00 o'clock P. M. Dated this 11th day of Sep tember, 1954. BY THE COURT RAYMOND J. CASE. ! THE PLATTS MOUTH, NEBRASKA, SEMI-WEEKLY JOURNAL Monday, September 13, 1954. PAGE FIVE home permanently in the new territory. He had been active in South Carolina politics, and at the time of his appointment was servine: as third auditor in the treasury department a post similar to a present assistant secretary. His political career had taken him away from home a great deal of time and both he and Mrs. Burt were anxious to establish themselves perma nently. They hoped that the permanent establishment would be the new territory of Nebras ka. Mrs. Burt apparently intend ed to join her husband as soon as suitable arrangements could be made. Instead, of course, his body was borne back to Pendle ton, South Carolina, in a mourn ful procession. Thus ended the career of the first governor of Nebraska ter ritory a career which, insofar as Nebraska relationships were concerned, began with his ap pointment August 2, 1854, and his departure from Pendleton, South Carolina, September 11. Manoah B. Reese, who served as Chief Justice of the Supreme Court from 1888 to 1890 and from 1908 to 1915, was born on Sep tember 5, 1839. Not much in formation is available relative to his early Illinois career, but he removed from Illinois to Osce ola, Iowa, and then late in the fall of 1871 to Plattsmouth. In a few months he moved on to Ashland and shortly thereaft er to Wahoo where he practiced jlaw for ten years, or until his election to tne supreme uourt. Even before that, though, he was active in public life in his new state. He was a member of the constitutional convention of 1875, and served as District At torney in the 4th judicial dis trict from 1876 to 1884. Judge Reese had many antago nists in his own party and in 1889 he met defeat in seeking the Republican renomination. He won the nomination again in 1899, but was defeated by for mer Governor Silas Holcomb, a Pooulist. He got the Republican nomination again in 1907, and was elected. He sought re-election to the court on the non-partisan tick et in 1915 but was defeated. by Conrad Hollenbeck. During the period from 1893 to 1904, Judge Reese served as Dean of the University of Ne braska College of Law. It was probably as dean of the law school that he made his great est impression upon the life", of the state. He was .Invariably popular with his students and gained a high reputation as a teacher. Speaking at memorial services held by the State Supreme Court, after Judge Reese's death, c. A. Robbins said, "near ly every advancement made in Nebraska in courses of lawT study, methods of instruction in law, requirements for graduation from the law school, and for ad mission to the bar of the state," were made during his tenure as Dean, and, "very much of that advancement was due to his 'un derstanding, sympathy, and in fluence." Judge Reese died September 28, 1917, after being in ill health for a number of months. Walter H. Harold R. Smith & Lebens Attorneys-at-Law Donat Bldg.
