RESOLUTION .WHEREAS: At one time there existed and engaged in business a corporation known as the Platte Mutual Insurance Com pany of Plattsmouth, Nebraska, an assessment . fire insurance association, organized on or about April 4, 1898: and the Ar tides of Incorporation ' of the said company were amended in 1915 to the effect that said in- surance association .should con- tinue for a term of twenty-five years from July 1, 1915. Meager and incomplete data available i indicates that the aforesaid as- .sociation ceased its venture and, business operations about the J year 1930; that all liabilities Luat uiu vi nj-giiL caioi the association were paid; and a marshalling of the assets of the company wnicn ccncisted of a certain mortgage on farm lands was attempted and ac- complished at a later date. , Some time during the period 1920-1922, the undersigned A. J. Trilety was elected Secretary Treasurer of the association to reduce the assets of the associa- tion into cash: such was ac complished by this officer of the . f i , association, wnu nuw iias un ue posit the sum-of $2,430.64; and this sum has been held in pay ment of any obligations that might exist or be asserted against this association. No claim has been presented against the association and ail its debts and liabilities appear to be fully satisfied. The last known directors as indicated by the incomplete records available of the associ ation were the following: H. M. Soennichseft, D. O. Dwyer, John Kopia, C. A. Marshall, J. A. Vondron and J. H. McMaken. The officers as indicated by such records were H. M. Soen nichsen, President, D. O. Dwyer, Vice-President, and A. J. Trile ty, Secretary - Treasurer. The records of the association, in cluding names of former policy holders have been lost; and of the last known directors and officers only the following are presently living, to-wit: H. M. Soennichsen, D. O. Dwypr and A. J. Trilety. However, on his belief that he was not an offi cer or director during tfte lat ter years of the activity of the association, and therefore, would be without capacity to properly join in 'this resolution, Mr. D O. Dwyer is not a signer here to; but has assented to the dis position of the funds as pro vided hereinafter. WHEREAS, the aforesaid last directors and officers of said association deem themselves to be trustees of the funds cn de posit; and desiring to make such disposition of the funds for such purpose as would meet the wishes of the former policy holders and members; and be cause it is impossible to aser tain who such former policy holders and members were to enable a declaration of a prop er dividend and payment to them, if so entitled thereto, ,NOW. THEREFORE, the said remaining officers and direc tors, as trustees of the remain ing funds in the sum of $2,34Q. 64, do hereby resolve that such unds, less expenses necessarily incurred herein, be paid over to the City of Flattsmouth on condition, however, that said moneys be used for payment of equipment and fixtures in ana for and upon completion of the presently contemplated City Auditorium or Community Building; PROVIDED. FURTHER, that should the plans for the afore said building be discontinued, or the City Auditorium or Com munity House not be structur ally completed or not be in pro gress of construction to com pletion within five years from he date of payment of these funds to the City of Platts mouth, or at the earlier date of discontinuance of said plans, these funds shall then become available to the Park Board of the City of Plattsmouth, for the purpose of acquiring appropri ate real estate to be dedicated as a public park andcr for the permanent development of pro perty presently owned or here after donated to the- City of Plattsmouth, but excluding the present Garfield Park, or for the permanent improvement of land owned by such organization. group or club having a broad and adequate base of commun ity interest that will enable ac complishment of the objectives herein described, subject to the limitations and provisions that where such land is not owned by the city, the property will be available to and the public will have access thereto at all times, and also that the development will not be in such manner as to be principally for or result largely to the benefit of the or ganization, group or club. Marcus & Son, and was greeted by a much excited clerk who gave his name as Nauman Haig. "The safe's been robbed!" he blurted. "And I accidentally knocked young Bert Davenport un conscious." Warren removed his ulster, pro duced a notebook and pencil and sat down near the divan with a matter-of-fact expression. Bradley began a tour of the room. "And now," Warren said, "let's have the facts and details. You first Haig." "Eert and I had come back to the office to catch up on some work. The burglar had . got the safe open and was stuffing the money into his pocket by the time I came at him. He turned evaded my rush, leaped toward a window which opened on to a f;re escape, and was through it before I could regain my balance. "I rushed over to the window , and was about to climb through in pursuit when the door opened be-' hind me. Thinking aid had come1, I turned, only to be struck over the head and things went black." Let me calL Bert's still a bit dizzy." "Warren gestured sharply. "I've another job for you. Haig. Go over there and do what Detective Brad ley tells you. Puzzled, Haig moved across the floor toward the detective, ar.d Davenport approached the tiesk. Sitting down he plucked the re ceiver from its hook and began to dial. The disk had scarcely whirled once when the room was suddenly, . plunged into darkness! j There was a moment of silence. Then Warren's voice smd. "Some thing's happened to the lights! j -Go ahead with your 'phoning, Dav-jT enport." I "I can't. It's too dark to see the . figures." And Warren said sharply: . "Lights, Jim!" Instantly the room was flooded again. At the desk, young Bert -Davenport blinked around the room. 'm Warren approached him. "Well, Davenport, I guess that . settles you. You'd better hand over -the money and make a clean con- " fession. It'll go easier with you. "Asking you to call Marcus, son was a gag.
