Minutes of last sesson ap proved, when the following bus iness was transacted in regular form : RESOLUTION: WHEREAS, a truck and trail er, owned by the Eastern Con struction Company, Inc., Dallas, Texas and driven by John Prat er, an employee of said county, collided with Cass County Bridge No. 971 on Cass County Road No. 220 in Section 29, Township 11 North. Range 11 East, destroying said bridge, WHEREAS, the Board of Cass County Commissioners feel that the cause of said accident was the negligence and carelessness of said John Prater and Eastern Construction Company, Inc., WHEREAS, said John Prater, and Eastern Construction Com pany, Inc. deny any liability for said accident and damage, WHEREAS, in order to com promise said disputed claim and avoid litigation, the Eastern Construction Company, Inc., has offered to pay to the County of Cass, the sum of Eight Hundred aud 00100 Dollars (800.00) in return for a complete release finally and forever discharging said Eastern Construction Com pany, Inc., its agents, officers, employees, successors and as signs, and said John Prater from any and ail claims and causes of action for said damage, and WHEREAS, the Board of Cass County Commissioners finds that a settlement of Eight Hundred and 00100 Dollars for its claims and causes of action for said damage is in the best interests of the County of Cass.
