After the fracas Davis was taken to Dr. Brendel's office for first aid then taken, to the Meth odist hospital, Omaha, or emer gency treatment. Davis stopped a blow near his right eye which ruptured a blood vein behind the eye ball. Blough, told the sheriff that Davis was abusing him Friday evening and at that time he- ignored him. Saturday afternoon Mr. Blough and his wife were in a local tavern when Davis came in and again began abusing him and a fist fight fol lowed. In county court Monday morning Blough plead not guil ty to charges of disturbing the peace which were filed against him by the county attorney. Charges of disturbing the peace have also been filed acyiinst Davis. Blough's trial is set for next Monday morning, and Davis's will Le after he is dismissed from the hospital. December 2?. 104 7. returning to his home Saturday afternoon in his truck after buy ing a few head of livestock at the sale barn when he noticed that the car ahead of him, which was driven by E. S. Newton of Plattsmouth, coming to a stop in the lane of traffic. Elliott took to the . right shoulder of the highway then pulled back on the highway and collided with a Tyson-Long- Gas transport which was coming from the south. Newton stated that he was pre paring to pick up his wife and daughter who were waiting for him at the place where the acci dent occurred. No one was injured and dam ages to the Elliott truck amount ed to $300 and to the gas trans port $150 according to the sher iff who investigated the accident. Mrs. Perry Dinman of Centralia. Hutzinger of 3105 Ed Creighton boulevard, Omaha, left the road south of the Union corner traveled up a steep bank on the left hand side of the road and rolled. The car traveled 160 feet off of the highway. Hutzing er and his passenger, Jack D. Jenson, of 2534 Saratoga, Omaha, only received a few cuts. Dam ages to the car were almost total. Jensen who had borrowed the car from Syliva C. Abraham, 15 So. 8th street, Council Bluffs, la., who is a nurse at the Mercy Hos pital in that city, told the sher iff that they were traveling south and were Dreparing to pass a truck on a hill when they noticed a car coming from the opposite direction. The highway was slick from the frost and they took to the left shoulder and rolled. Telephone 238 Files Suit Against Cass County In the office of the clerk of the district court Monday morn :ns an action was filed in which William M. Stoner, assignee of th.- Fidle Transfer Co., is the plaintiff and the County of Cass Nebraska defendants. The action is an appeal from the action of the board of coun ty commissioners disallowing claims of the Fidlor company, as not being filed within the time specified by law. There are a number of claims and they aggre&Mte $6,032. Henry McMaken and Wife Visit in City Mr. and Mrs. Henry C. Mc Maken. who have been located at Cook, Minnesota, are here for a short visit with relatives and old friends, while enroute from Minnesota to California, where they exptct to spend the winter season. The job on which Mr. McMak en is contractor, is closing down for the winter season, but will reopen in the spring and ac tivity will be resumed. Mr. and Mrs. McMaken ore going from here to Kansas City Missouri, where they will visit their son. Henry Guv McMaken and family over the holiday season. They will go from Kansas City to Coronado, California, where another son, William Stewart McMaken. and family make their home. They will stav there until time to return to the job in the northland. Hofus, Jr., George Sorich, Jr., and Wm. L. Erown, all of Oma ha, Sunday afternoon after they were found back on the property of a farm north of Plattsmouth. The farmer had told them a few minutes before to leave his property because he feared stray rifle shots may hit his stock. The farmer had lost one cow previously and had several other shot in the leg by hunters. Sell Vanek Land In South Plattsmouth Saturday morning sale of real estate in the case of Antonia Vanek vs. Anna Vanek, et al was held at the county court house. The land sale was in charge of Attorney Richard Peck, refer ee in the case, with Smith & Lebens as the attorneys. The land which consists of some four acres on south Lin coln avenue was sold to Clyde Meisinger for $3,050. POLICE COURT NOTES Saturday afternoon Judge C. L. Graves had a short session of police court to hear complaints that had been filed against Roy al Green for intoxication and one against William Jackesk, charging- him with intoxication and disturbing the peace. Green was given a fine of $10 and costs and Jackesk was fined $10 for intoxication and $18 on disturbing the peace. PURCHASES NEW HOME Mr. and Mrs. Carl Senf have purchased the J. P. Peterson property in the south part of the city and are plannipg to move to the new home in a short time.
