From Tuesday' Daftv The city council at its session last evening received a communication from J. Howard Davis, setting forth that he was the owner of more than sixty per cent of the real estate in Oakmont addition to the city, asking that the city as authorized by law, create a paving district, from Chi cago avenue through the new addi tion to 12th and Gold streets. The prayer of the petition was granted and the necessary steps to create the district will be taken. The new pav ing will leave a stretch of unpaved roadway from Gold to Rock on 12th street, Mr. Davis explaining that probably the greater part of the resi dents of the addition would use the Chicago avenue entrance to the ad dition. Chief O. Sandin. of the fire depart ment, reported one fire for October, that of October 7th at the Eell pits north of the city. Police Judge C. L. Graves reported that for the week of October 26 there had been three arrests and $S in fines and costs collected. Chairman Webb of the tax property committee presented signed contracts for Fred Rice Mr. and Mrs. Clifford Sutton property recently purchased of city, also the insurance policies. and the and for the The city will sign up the contracts at once. Chairman Noble of the streets, alleys and bridges committee, report ed that Supt. Stahl of the Burling ton had been here and looked over the ditch along the shop property on Lincoln avenue, promising that he would have the company engineers here to confer with the city engi neers to see if th?y might be able to help in the situation. The city would be able to purchase this with monthly payments of $114.50. The purchase of the maintainer was made with nine of the council voting for and Webb passing on the matter. It was voted to have the city ask for the five per cent government tax exemption and to notify the company selling the equipment of che desire of the city. Councilman Finnefrock chairman of the license committee, reported that the committee had investigated the request of Ray Wright for per mission to place Venetian blinds at the window of his tavern. It was found that the city ordinances forbid the obstructions in the windows that might shut out the view. The re quest was not granted. Chairman Fainter of the fire and writer committee. reDorted a leuer had been received by the city from T. H. Pollock, local manager or me Plattsmouth Water corporation, en closing a letter from the headquar ters of the company at Portland, Maine. The company had turned the letter of the city with, the ap praisals, over to the engineers of the Plattsmouth Water corporation for study. The company also en closed a number of questions regard ing the city appraisal, and stated that it would be impossible to get conference within the next ten days as had been suggested, ine letter of the company was turned over over to the Henningsen Engi neering Co.. representing the city, for reply. Mr. Painter also reported that the 500 feet of hose purchased by the citv had been received and tested out excellently. Chairman Schutz of the WPA com mittee brought out the matter of the widening of the highway near Webster boulevard near the old mill site, the city having secured addi tional ground to make a much bet ter turn. There was a lengthy dis cussion of the matter with the de cision that the city would have some of the dirt removed and estimates secured of what would be necessary and also as to the quantity of con crete to be needed for use in widen ing. Engineer Mann was authorized to prepare the figures and estimate that the city might prepare to call for bids on the work rather than at tempt the making of an additional WPA project. The matter of letting the bids for the construction of the sanitary sewer district in Oakmont was brought up and two bids received that of the Yant Construction Co. and the McClay Construction Co The contract was finally awarded to the Yant company. CASE Phone 199 or 268-J Homes Needed for Boys, Girls Nebraska Children's Home Society Able to Place Children in Permanent Homes A number of mighty fine boys and girls of school age are badly in need of permanent homes, according to word received from G. M. Porter, field representative for the Nebraska Children's Home Society. Mr. Porter, who will be in Cass county very shortly for the annual solicitation of funds for the Society, calls our spec ial attention to one family of three children which includes a darling little girl of about 9 and brothers 11 and 13. These children would like to have a home where they can all be together. Then there are some fine little girls of 9. 11, 12 and 13, all in need of good homes. Nebraska Children's Home Society is well Known in cass county, wnere it has served more than one hundred children and unfortunate girls. The Society, which was founded in 1893 for the care and placement of nor mal children of all ages, is non-sec tarian and is supported by volun tary donations. It is not operated or supported by the State. Your help in cash or food is badly needed and will be much appreciated by Mr. Porter. Members of the local advisory board are Dr. R. P. ANOTHER BAND WAS FAMOUS IN EARLY DAYS Speaking of Czech music in early days recalls to the minds of a large number of residents the time when the second Bohemian orchestra which followed the Janda band proved a real hit. It also was known as the City Band and this group had postcard pictures taken. The orches tra consisted of Tom Gradoville, Tom Svoboda. Julius Kalasek, Roy Holly, Frank Janda. Jr., Charles Hula, Tim Wooster, Frank Aschenbrener, Joseph Sedlak, Charles F. Janda. Out of this number two are now deceased, Frank Janda and Frank Aschenbrener. This orchestra flourished approximately thirty-two years ago. The late Mr. Aschenbrener played in the orchestra when he was only 14. These music leaders existed for some time. Lincoln Lumber man Leaves Large Last Bequests Riley M. Tidball Names Local Mem bers of the Family as Bene ficiaries of Will. Will of Riley McMillan Tidball, former Lincoln lumberman, filed in Lancaster county court Monday, gives $5,000 of his estate to the First Pres byterian church of Lincoln. It is provided that the amount shall be applied to the principal of the church mortgage if there i3 one and if not it shall be paid to the trustees to be invested in United States bonds. Mr. Tidball died Oct. 21. One-half of his estate is giv n to his wife, Emma B. Tidball. In an other document filed in the county court it is stated the estate is up ward of $50,000. He also gives Mrs. Tidball the home at 2136 C st. for life and his library and household goods. From the other half of his estate certain bequests are made to rel atives and friends and the residue after these bequests are paid goes in equal shares to Frank C. Patter son, Omaha, a nephew and to James Edward Pallett, a grand nephew. The will after providing $500 for the care of the grave of his brother, John, buried in Riverside cemetery at Crete and $500 for flow ers for Memorial day for the family lot, provides for the residence being given to his widow to occupy until death or to receive the income there from for life. At her death the property goes to his nephews, Frank C. and William D. Patton of Omaha and to James Edward Pallett, grand nephew. To Mrs. Flora Tieger, a friend of the family, he gives $500 to Thomas S. Allen, another friend $500, to nieces, Mrs. Mary S. Reed, Boulder, Colo.; Katherine Lockwood Johnston, Idaho Springs. Colo., and Mrs. Har riett Johnson, $5,000 each; to Wil liam D. Patterson. $5,000 to George H. Glade, jr., a grand nephew, $3, 000 and the same amounts to Mrs. William P. Glade. Donald H. Pallett and Harold A. Pallett, sons of W. H. and Carrie Pallett. John L. Tidball III, a grand nephew, is given $5,000. This sum is to be invested in United States bonds and when $100 has ac cumulated it shall be reinvested and the money paid over in a lump sum when John L. has reached the age of 28 years. Violet S. Tidball, widow of John L., is given $5,000. His will said he had not forgotten cer tain other nieces but he had provided for them previously.
