PROPOSED CONSTITUTIONAL
AMENDMENT.
I The following proposed amendment to the
constitution of the State of Nebraska, as herein
aftei set forth in full, is submitted to the electors
; fif the State of'Nebraska, to lie voted upon at the
| general election to be held Tuesday, November
3rd I D. 190b.
A JOINT RESOLUTION to amend Sections
two [2), four (IS, live (5), six (H) and thirteen (13)
of Article six 4) of the Constitution of the State
of Nebraska, relating to Judicial Powers.
He it Resolved by the Legislature of the
State of Nebraska:
Section 1. Amendment Proposed. That Sec
; tion two (2) of Article six H of the Constitution
of the State of Nebraska be amended to read as
i follows:
Section 2. Supreme Court; Judges; Juris
diction.) The Supreme Court shall consist of
seven (7; judges; and a majority of all elected and
• inalitied judges shall lie necessary to constitute
a quorum or pronounce a decision. The Supreme
Court shall have jurisdiction in all cases relating
to the revenue, civil eases in which the state is a
party, mandamus, quo warranto, habeas corpus,
and such appellate jurisdiction as may be pro
j vided by,law.
! Section 2. Amendment Proposed.) That
' Section four. (4) of Article six (<») of the Constitu
tion of the State of Nebraska, lie amended to read
as follows :
Section I. {SlM’KKMK COURT, JUDGES, ELEC
TION, Term, Kehidem*K.) The judges of the Su
preme Court shall be elected by the electors of
the state at large; and their term of office except
us hereinafter provided shall lie six years. And
saiii Supreme Court judges shall during their
term of office, reside at the place where the court
is holden.
Section 3. (Amendment Proposed.) That
Section five | | of Article six |b | of the Constitu
tion of the State of Nebraska be amended to read
as follows:

tion. Tknm, Chief Justice. | That at the gen
eral elect ion to be held in the state of Nebraska
in the year 1000, and each six years thereafter,
there shall be elected three 131 judges of the Su
preme Court, who shall hold their office for the
period of six years; that at the general election
tube held in the state of Nebraska in tin* year
1011, and each six years thereafter, there shall be
elected three | 31 judges of the Supreme Court,
who shall hold their office for the period of six
years; and at the general election to lie held in
t he state of Nebraska (in t he year 1013 and each
six years thereafter, there shall be elected a Chief
Justice ot the Supreme Court, who shall hold his
office for the period of six years. Provided that
the member of the Supreme Court whose term of
office expires in January 1011, shall tie Chief Jus
tice of the Supreme Court, during that time until
the expiration of his term of office. And pro
vided further, that upon the adoption of these
amendments by the electors of the State, the
Governor shall,• immediately upon issuing his
proclamation declaring said amendments adopt
ed, appoint four 141 judges df the Supreme Court,
two [2] of whom shall he appointed to hold said
office until their successors shall lie elected at the
general’election in 1909, ami have qualified; and
the other two 121 shall hold their office until their
successors shall be elected at the general election
held in Mil, and have qualified.
Section 4. [Amendment Proposed.] That
Section six |t>| of Article six |ti| of the Constitu
tion of the state of Nebraska, be amended to read
as follow’s:
Section t». | Chief Justice. | The Chief Jus
| t.iceshall serve as such during all the term for
which he was elected. He shall preside at all
terms of the Supreme Court, and in Ids absence
the judges present shall select one of their number
to preside temporarily.
Section 5. [Amendment Proposed.] That
Section thirteen [13] of Article six |*>i of the
Constitution of Nebraska lx* amended to read at
follows :
Section 13. [Judges, Salaries.] That judges
of the Supreme Court shall each receive a salury
of $4500, and ‘the Judges of the District Court
shall each receive a salary <>f $300u per annum,
payable quarterly.

said proposed amendment is submitted to the
qualified voters of the State of Nebraska for their
adoption or rejection at tho general election to
he held on Tuesday, the ;ird day of November, A.
D. 1908,

hand and affixed the Great Seal of the State of
Nebraska. Done at Lincoln, this 15th day of
July, in the year of onr Lord, One Thousand
Nine Hundred and Light, and of the Indepen
dence of the United States the One Hundred and
Thirty-third, and of this State the Forty-second.

m., of Friday, September 18, 1908, at office
of A. It. heim, for constructing the ditch
es, dykes, levees, spillways, Hood gates, in
lets, etc., in Drainage District Number One,
itichardson County, Nebraska Eacn bid must
lie accompanied by a certified check on a National
Hank doing business in the State of Nebraska, or
Chicago or St. Louis exchange, payable to tho
Treasurer of the Drainage District, in tho sum
of five per centum of the amount of the bid, un
less the said per centum exceeds ten thousand
dollars, in which case the certified check shall be
for ten thousand dollars. The successful bidder
will be required to furnish a bond in an amount
equal to twenty-five per centum of the amount
of the contract. The right is reserved to reject
any or all bids. Plate, plans, profiles, and speci
fications can lie seen and examined at the office
of Drain Commissioner, K. E, Grinstead, Salem,
Nebraska, or at the office of A. M. Munn, engin
eer, Nebraska City, Nebraska.

Nebraska: In the matter of probating the Last
Will ami Testament of James M. Whitaker, de
ceas'd. Notice is hereby given to all persons in
terested that E. H. Towle has deposited in said
court an instrument purporting to be the last
will a*»d testament of said James M. Whitaker,
deceased, and filed a petition praying that said
instrument may be allowed and probates 1 as the
last will and testament of said deceased, and that
he may l>e appointed executor thereof. It is or
dered that the Mime 1h* heard by the court on
Thursday, the 17th day of September, 1908, at 10
o'clock, a. m., in the county court room in Falls ,
City, in said county, when and where all persons
interested may appear and contest the probate
thereof.
