The Drainage Question.

responds to John W. Towle in
regard to the drainage question ,
We publish both letters for the
bencgt of our readers who are
interested in tnis question :

Dear Sir I am in receipt of
your letter and note your great
modesty. Now if you do not
care to write in competition
with the great authorities on the
subject of drainage , prehaps
you will give us a letter just
stating the plain facts as to the
present condition of our Nema-
ha drainage district , stating
about when you expect to let
the contracts , sell the bonds ,
etc. , and when you contemplate
that the work should be started.
Personally. I would like to see
this thing come in reality at the
earliest possible date.
In my business travels in west
ern Iowa , I have had occasion to
investigate at least twenty-five
drainage propositions and talk
ed with the county boards , with
the engineers , and with the land
owners themselves , concerning
the results ot these districts.
It seems to be their unanimous
opinion that great benefits are
being derived from them.
A great many of these ditches
have less than one.fourththe
fall thnt our Netnaha ditch would
have. I feel very confident that
the plan contemplated by your
board , when carried out , will
add at least $50 per acre to the
value of the land in the valley.
So let us hear from you Grin-
stead , for I am sure that there
are many others who are now
outside of the county that would
like to know just how far mat
ters have progressed.

Dear Sir In replying to
your favor of March IGth I will
say that we can see day.light
just a little ahead. To be brief ,
we now confidently expect to be
able to issue and sell drainage
bonds by June 15th , and to let
contracts by not later than
August 1st. Contractors should
begin work soon thereafter.
It no doubt appears to those
like yourself , who are largely
interested , that the many ant
long delays are inexcusable ,
and that the drainage board
should have been more expedi
tious. I desire now , in this
connection , to say this , that
there are more than 300 different -
ent land owners in the drainage
district , each one to be deali
with according to the technica
forms of law. There are adults
and minors ; some minors with
and some without guardians
In all cases guardians must be
appointed , where none exists
There are non-resident lam
owners. The processes of the
court must be served on these
in some way , usually differeu
to others. There are the Indian
land owners to reckon with.Ve
had congress to make a special
law to reach these lands. This
required much time , correspond ,
ence and patience. Of the
Indians there are adults and
minors , resident and non resi
dent ; somein.Oklahoma , some in
Kansas , and some in Nebraska ;
all had to be found , which was
hard to do. Guardians had to
be appointed for the minors.
And there are the railroads and
the county roads to deal with.
These have been brought into
the drainage district , according
to the forms of law , made and
providedinsuch cases by an order
of the District Court more than
two years ago. The M. P. R.
R , Co. , after contesting the
right of the court to make it
chargable for benefits , submit
ted to the ruling of the court.
The C. B. & Q R. R. , however ,
appealed to the Supreme Court
ot the state , and made the con
tention that the drainage law
was unconstitutional. This
made a delay of two years , for

t took this long for the Supreme
Court to reach and decide the
case. We did not care to go on
and make additional expense ,
ind then , possibly , find that we
iad no drainage district. The
Supreme Court finally decided
or the drainage district , exclud-
ng , however , the depot grounds ,
R. R. right of way , and county
road right of way from the
drainage district , but making
each assessable and chargeable
: or benefits. This is just what
: he drainage people want , so
the decision was a complete
victory for the drainage dis
trict. The R. R , people so
understand , and are waiting to
comply with the law.
In the matter of benefits to
the county roads and sanitary
benefits to the community , as
contemplated by the law.
The County Board of Super ,
visors , none of them being from
Missouri , so understand , and
will not have to be shown , as
was the railroad people , and
will be ready to do business
with us right away.
It took about seven months
for the engineer to complete his
work. We had a contract with
him that his work should be
subject to the review of some
other engineer. This was com
plied with by having an expert ,
6. G. Elliott , from Washington
D. C. look over the same. Mr.
Elliott spent several days in
the Nemaha valley , and in the
office with Mr. Munn , our engi
neer. There have been two or
three minor changes made in
location of main channel , Mr.
Munn , Mr. Elliott and the drain
age board all concurring in the
same.
The board meets in Salem ,
March 23 to adopt the amend
ed report of engineer. About
three days more of board sessions
one day more with District and
County court , one day with the
County 13oard of Supervisors , a
short meeting with 0. B , & Q.
R. R. officials ; all of these ar
rangements we expect to close
up by April 15th. , about which
time we expect to advertise for
the sale of bonds , which will
require about twenty days , af
ter which we will advertise for
contractors , setting a day for
the letting of the contracts ,
which will require about twenty
days additional.
It is a significant fact , and
creditable to the intelligence of
the land owners that although
in the settlement of these num.
erous cases we were threatened
with many expensive lawsuits ,
yet the same have been settled
in a way just and satisfactory
to all , with possibly one or two
exceptions.
It is almost universally the
case that the most difficult to
deal with , the most exacting and
the hardest to satisly. is the
man or woman who owns just a
few acres , they fail to compre
hend the fact that they receive
the proportionate benefit that
the larger land owner does.
One owner with just three acres
of brush and timber , worth
about § 25 per acre , files a claim
for $200 damages/ His land is
not used , any part of it , for
right of way , nor madeinaccess-
able to him , no more than now ,
by the improvement. Some
tanners , however , with only an
acre or two , say "it it is neces
sary to take all my land to
carry out the drainage project ,
simply take the land. "
The land owners are now ,
universally , favorable to the
drainage project.
I did not have the honor to be
a soldier in the Civil War , al
though of proper age ; but I
voted and prayed on the right
side , the side that won , my
votes weren't counted , for " 1
lived in Dixie's * land where ]
was born. " I now have the
same satisfaction of knowing
that our drainage board is doing
a good thing for the other fel
low who gets mad at us , that ]
had during the Civil war when I
was praying to have the other
fellow skinned.
I never , in my life , had a
malicious grudge at any man
and wanted to get even with
him for an imaginary grievance
I have never allowed such feel
ings to creep into my makeup.
If , however , I ever should have
such feelings towards any man
I would fall into my old habit
of praying for such things as I
cannot reach , aud ask the good
Lord to help place him on the
drainage board , and inspire him
to do his duty fearlessly and
honestly. Then T would say
"Lay on Me. Duff , " cuss him ,
d n him , I've had enough.

Stop Laying Rails.
After having employed a force
of men in distributing new and
icavy steel along its track ,
from Falls Qity to Omaha , the
Missouri Pacific has officially
innounced that its policy of re
trenchment includes in its pro
gram the picking up of all this
new iron and sending it else
where for use.
The laying of new ties and
steel was commanded in the
spring of 15)07 ) by the stale rail
road commissioner as one of its
first official acts.
The members of the commissi
on took trips over the road to
examine its physical condition
and the consensus of their
opinion was that the road bed
was in a shape that made it
dangerous for the transportation
of human beings or property.
Pre-emptory order was given
for the improvement of the road.
Great activity was noticed for
awhile. Gangs of men wore
put at work grading aud a few
new ties were made to replace
rotten ones. Then , ol a sudden
the work ceased. It is a coinci
dence that the activities of the
state railroad commission ceased
at the same time. The roadbed
is in but little better shape than
it was , the wrecks are almost
as numerous and all the heavy
steel that was to be laid and
the new fast train service that
was to be put on is a myth a
pipe dream. Auburn Republi

Tbe Roads.
Wherever the roads have been
dragged they are fine , but many
farmers fail to drag the roads as-
they should. In Jackson county
the roads are something fierce.
In Richardson county , Neb. , the
farmers drag them pretty well
and some stretches of road are
level as a floor. In Brown
county miles have been dragged
with good effect. Carriers Cart
er and Weyer report more than
one-third their routes dragged ,
or fully eight miies. Every
mile should be dragged. The
farmers should understand that
in order to have free mail de
livery they owe the carriers and
the public the common courtesy
of good roads , and good roads
may be had everywhere if each
farmer will devote a lew hours
use of the road drag. Now
won't the well-to-
big , generous - -
do farmers see to it that the
strip ol road bordering their
land is dragged ? There couldn't
bo a better investment for all
men than good roads. Ilia-
