braska is required to keep the money of sai city equally divid ed and in which he is required to keep said money as so divided deposited to require said treas urer to state in his monthly re ports to the mayor and Council of said city the average daily balance of each fund in each of said places of deposit dur ing each month to provide a penalty for the violation of this ordinance to repeal the Resolu tion passed and approved on the 27th day of November 1911 and to repeal any and all resolutions ordinances and parts of ordinanc es in conflict with this ordinance Be It Ordained by the Mayor and Council of the City of Mc Cook Nebraska fSeetion 1 The Citizens Nation al Bank of McCook Nebraska a regularly organized bank located in said city and the McCook Na tional Banlc of McCook Nebraska a regularly organized bank locat ed in said city having each fil ed with the cleric of said eity an agreement to pay said city the rate of interest named in said ordinance no higher -rate having luen fixed by resolution 1 anL having each filed with said clerk a bond in the penal sum of thir ty thousand dollars with three or more sureties which bonds and sureties1 have been approved by the Mayor and Council of said city as to form of bond and suf ficiency and number of sureties all in compliance with ordinance number 212 of said city and pre vious to the passage by said may or and council of the Resolution passed on the 27thd ay of Novem ber 1911 and imblished on the 30th day of November 1911 and thereafter to wit on the 1st day of December 1911 the First Na tional Bank of said city having filed Avith the clerk of said eity a similar bond which has also been approved and said three banks being all the banks in said city the city treasurer of said eity is hereby ordered to keep all the money now on hand or hereafter received in each fund belonging to said -city equally di vided among and as so divided equally deposited in said ens National Bank said McCook National Bank and said First Na tional Bank respectively and in so depositing the money of said eity now in the hands of said treasurer or hereafter received and in paying the warrants of said eity said treasurer shall make such deposits and payments of the money in each fund belong mg to said city in such manner that at all tunes one third of such funds shall be deposited in said Cations National Bank one tihird of such fund shall be de posited in said McCook National JLfranK and one auurd tnereoi in said First National Bank respec tively and int his monthly reports to saad mayor and council said treasurer shall state the average daily balance of each fund in each of said banks during said month Section 2 Any person aaIio shall violate any of the provis ions of this ordinance shall up on conviction thereof be fined in any sum not less than one dol lar nor more than one hundred leet to provide sufficient sus tenance or shelter1 therefor ait any season of the year Section 4 It is hereby made the duty of any poliee officer of this eity to immediately arrest any person or persons Aiolating any of the prm isions of this or dinance Avithout warrant or pro cess and call upon by standers or others for assistance AAdien the same may be necessary to make such arrest Section 5 Any person or per sons Arho shall Ariolate any of the provisions of this ordinance shall on conviction thereof be fined in any
