WYMORE BOY WINS THE DEBATE
t Victor Coulter Carrief Off the First
Honors in Annual Contest
Victor Coulter of Wymore carried
o the firct honors in the annual
championship debate of the Nebraska
hfgh school debating league which
was held Friday evening in Memor
ial hall The award of second place
went to Junius G Oldham of Kear
ne3 and William P Ackerman of
Havelock carried off third honors
Coulter who represented the south
eastern district of the league won
with ease being the most polished
and effective speaker to appear upon
the platform Friday evening His
argument was well rounded well sup
ported by authorities and was deliv
ered in a fluent and forceful style
Oldhams analysis of the question
as to whether die navy of this coun
try should be increased was better
than that of Coulter but he appar
ently was a less experienced debater
Ackerman carried the audience with
him from the start as he was the
youngest speaker of the evening
and presented at the outset an elab
orate statement of facts
In all ten high school students
spoke representing the tend istricts
of the league These debaters were
chosen after a series of debates be
tween over fifty high schools of the
state which lasted for nearly three
months But one young lady spoke
she being Miss Lucy Jeffords of
Broken Bow
The judges of the contest were
Judge A J Cornish of the Lancaster
district court Dean W G Hastings
of the college of law of the univer
sity and Albert Watkins of the State
Historical society Prof M M Fogg
president of the league presided and
Prof Edwin Maxey officiated as time
keaper
The other speakers of the evening
were Harrison Line of Diller John
T OConnell of Atkinson Elmer K
Nelson of Sidney Clarence Eidam of
Fremont William W Wertz of Tren
ton and Ernest W Moehnert of Mad
ison Lincoln Star

The claim of the constitutional priv
ilege of refusing to give self-incriminating
evidence has been pushed to
such preposterous lengths that any
victory won in a fight against such
abuses is to be heartily welcomed
By the decision in the United Wire
less contempt case the supreme
court put a quietus on at least one
of the morbid excrescences that have
grown so luxuriantly out of what
was originally a sound and simple
principle designed to prevent perse
cution and injustice As a result of
this decision an official of a corpor
ation cannot refuse to give up pos
session of its books for examination
by grand juries or courts on the
plea that he may be incriminating
himself by so doing It is to be hop
ed that the decision though nothing
more than what most sensible law
yers probably regarded as a matter
of course may have some moral ef
fect upon courts generally beyond its
legal implications The decision itsel
rests expressly upon the peculiar stat
us of a corporation as distinguished
from an individual but if the su
preme court had been inclined to in
vest the privilege with that all-embracing
sanctity which has been as
cribed to it by some of our courts it
would have found no difficulty in en
abling it to cover the corporation
books with its magical powers of pro
tection A return to a good horse
sense view of what has practically be
come the criminals and not the in
nocent mans privilege is one of the
crying needs of the time New York

Mr and Mrs Jesse Naden from
Franklin Neb arrived Thursday to
be present at the graduating and al
umni meetings
This section of the country was
visited by a very heavy wind storm
Saturday evening It over turned a
number of small buildings

Rea Oman passed through here on
Wednesday enroute to Marion having
taken a load of lumber to Indianola
and bringing one back to Marion
Mr and Mrs George Woods of
Lincoln came in Sunday George re
turned home Monday evening while
Mrs Woods will visit a few days
The graduating exercises on Friday
evening were very well attended The
hall was most beautifully decorated
Each member did his part well The
band played a few selections

Ordinance No 199
An ordinance to amend sections 11
33 34 and 35 of Ordinance 170 of
the Revised and Compiled Ordinances
of the City of McCook approved the
17th day of July 1908 and to repeal
said original sections 11 33 34 and
35 of said Ordinance 170 of the Re
vised and Compiled Ordinances of
said City
Be It Ordained by the Mayor and
Council of the City of McCook Ne
braska
Section 1 That section 11 of Or
dinance numbered 170 of the Revis
ed and Compiled Ordinances of the
VJity of McCook be amended to read
as follows
Section 11 The mayor with the
consent of the council may appoint a
city attorney an overseer of streets
a city marshal who shall also be
chief of police and a city physician
each of whom shall hold his office for
one year unless sooner removed by
the mayor with the advice and con
sent of the council
Section 2 That Section 33 of said
Ordinance numbered 170 be amended
to read as follows
Section 33 Any person appointed
to the office of City Marshal before
entering upon the duties of his of
fice shall take and subscribe the oath
required by law and shall execute a
bond to the City of McCook with
good and sufficient sureties to be
approved by the city clerk of the City
of McCook in the sum of two hundred
dollars Any person appointed to the
office of overseer of streets before
entering upon the duties of his of
fice shall take and subscribe the
oath required by law and shall ex
ecute a bond to the City of Mc
Cook with good and sufficient sure
ties to be approved by the city c
of the City of McCook in the sum
of two hundred dollars
Section 3 That Section 34 of said
Ordinance numbered 170 be amended
to read as follows
Section 34 The overseer of streets
shall subject to the order of the
mayor and council have general
charge direction and control of all
work on streets sidewalks culverts
and bridges of the city and shall per
form such other duties as the coun
cil may direct
Section 4 That Section 35 of said
Ordinance numbered 170 be amended
to read as follows
Section 35 The city marshal who
shall also be chief of police shall
at all times have power to make or
order an arrest with proper process
for any offense against the ordinances
of the city and to bring the offender
for trial before the proper officer
of the city and to arrest without
process in all cases where any such
offense shall be committed or at
tempted to be committed in his pres
ence and shall perform such other
duties as the mayor or council may
direct
Section 5 That said original sec
tions 11 33 34 and 35 of said ordi
nance numbered 170 as said sections
now exist are hereby repealed
Section 6 This ordinance shall
take effect and be in force from and
after its passage approval and pub
lication according to law

the office of the city clerk of the
City of McCook Nebraska until 12
oclock noon central standard time
May 22 1911 for a contract to per
form ail work and furnish all mater
ials necessary for laying such side
walks cross walks and curbs within
the corporate limits of the City of
McCook as the city council may ordei
to be laid during the current muni
cipal year Bids shall be made per
square fcot for cement as per ordi
nance provided Side walks cross
walks and curbs to be laid in ac
cordance with the provisions of the
ordinances of the City of McCook
and the specifications on file in the
city clerks office and subject to
the approval and acceptance of the
city engineer All side walks cross
walks and curbs to be guaranteed by
the contractor for a term of two
years from the date of acceptance
and renewals to be guaranteed for
a like term The contractor to fur
nish a bond in the sum of one thou
sand dollars with sureties to be ap
proved by the city council
The city engineers estimate is as
follows Sidewalks per square foot
4 inches thick 12c Cross walks per
square foot fi inches thick 17c
Curbing per square foct 15c of
face exposed
The city council reserves the right
to reject any and all bids
