assessment created under the new revenue law holds its initial session tomorrow for the purpose of selecting a secretary George D Bennett book keeper in the auditors office has been agreed upon for this position at a salary of 1500 per year his place in the auditors office being taken by Henry Seymour of York now a clerk in the insurance de partment Several county treasurers who remitted too much school fund money to the state treasurer last year probably will experience a great deal of difficulty in getting the surplus cash returned Last winter the legislature ordered the matter straightened by drawing warrants against the permanent fund but Treasurer Mortensen has decided to refuse to comply with the order asserting that the fund is inviolate and cannot be drawn against under any circum stances whatever His position is that no matter if thousands of dollars should be annexed to the fund through mistake not a pen ny of it could be withdrawn The well known bankers to de liver the policies as agreed The Union Casualty company of St Louis complained to Mr Pierce about Marston early last fall stating that he was not authorized to solicit business for them Later the accident de partment of the Aetna company made a similar complaint and finally letters from Marstons dupes in Elmwood Falls City and Silver Creek began to pour into the auditors office It is said that Marstons pat rons at Elmwood and Falls City received absolutely nothing in re turn for their money while at Silver Creek parties who paid for Aetna policies received certificates written by the American Fratern ity company of which the insur ance department knows nothing Marston is said to have resided for several months at Table Rock and was last heard from in Grand Island Any one possessing in formation relative to his present abode will confer a favor by com municating with Deputy Pierce General Colby indignantly de nies that he has a dollar in his pocket which belongs to the state or nation but promises that in case a careful investigation of his accounts develops a shortage the amount will immediately be made good So far as the question of armory rent is concerned General Colby seems to be in the right It appears that there was a small difference of opinion between the Adjutant General and Captain Murdock commander of the Wy mote battery and that General Colby when retiring from office retained the battery allowance for armory rent for the purpose of forcing the captain to make some disposition of a lot of obsolete ac coutrements then in his charge General Colby made no attempt to conceal the fact that the arm ory rental was in his pocket to the contrary he notified Captain Murdock that the money would be with held pending a settlement of the dispute and also reported the facts in the case to his suc cessor in office Genetal Culver The money eventually was paid to the battery commander and the controversy adjusted With regard to the charge of selling blankets to the state and mis appropriating the proceeds General Colby maintains his in nocence but has made no de tailed explanation The state is in no wise involved in the matter which is one entirely between General Colby and the govern ment W F Thompson secretary of the Nebraska food commission has notified the officets of the Re tail Grocers association that in future he will hold merchants di rectly responsible for the wares they have in stock This does not mean that when articles bear ing a deceptive label or contain ing injurious substances are found in a merchants store he will be carted off to jail but it signifies that retailers must break them selves of trie habit of repeatedly purchasing bogus vinegars ciders etc and then pleading ignorance of the fact that the stuff is not all that the labels indicate Heretofore the practice has been to prosecute the wholesaler only bit as the foreign jobbers were chief offenders and were be yond the reach of the Nebraska law they continued to ship infer ior goods into the state knowing that the worst that could happen would be for the food commission to ordet the goods returned Ne braska merchants to a consider ble number continued to purchase brands which they knew to be fraudulent selling the same in direct competition with the wares of Nebraska wholesalers and manufacturers who were forced to do an honest business under penalty of the law The natural result was almost to destroy the trade of the Nebraska houses especially makers of vinegars and ciders Under the new plan should a merchant persist in offering for sale goods which he must know to be inferior or even continue to patronize houses which he has been warned are doing an illicit business Secretary Thompson will apply the state law to his
