Petition of Charles Ebcrt and others asking
for a public road was read and on motion con
sidered Tho board finds that all owners of land
along tho line of proposed road havo given con
bent thereto in writing On motion samo was
granted establishing a public road as follows

nineteen 19 in township numbered two 2
north range numbered twenty eight 28 west

On motion the treasurer was instructed to re
fund to G W Godfrey the sum of 233 the
amount of personal tax illegally assessed in 1901
by reason of double assessment and paid by
him under protest
On motion tho treasurer was instructed to re
fund to Edward Fitzgerald tho sum of 300 on
presentation of city poll tax receipt the amount
of poll tax erroneously assessed to him in 1901
by reason of double assessment and paid by
him under protest
On motion the treasurer was instructed to re
fund to W S McTaggart the sum of 19S the
amount of school bond tax erroneously assessed
to him in 1901 and paid by him under protest
Claims of James Cain and Charles Blackburn
for refunding poll tax 300 each assessed to
them in 1901 and paid under protest were re
jected
On motion the following resolution was in
troduced
Be it Resolved by the board of county com
missioners of Red Willow county Nebraska
that the county treasurer of Red Willow county
and state of Nebraska be and hereby is notified
and instructed to collect any and all delinquent
personal tax now shown upon the tax lists of
said county in accordance with the law in such
cases made and provided as shown by section
89 chapter 77 of the 1901 Compiled Statutes of
the State of Nebraska Immediate and pre
sistent action either by distress warrant or
otherwise is demanded
