low county, Nebraska, to secure the payment
of their one certain promissory note, payable
in installments as follows, one installment
of fifteen dollars due June 1st, 1SS7, and nine
installments of twelve dollars each, the first
one of said nine installments being due on
the first day of December, 1887, and one in
stallment maturing every six months there
after until the maturity of the last installment
which matured December 1st, 1891. And
also to collect the amount due upon seven
coupon notes of twenty-eight dollars each,
signed by Gerhart Bongers and secured by a
mortgage on the real estate above described,
executed by Gerhart Bongers and Sofia Bon
gers. That there is now due on said notes
and mortgage, including taxes on said prem
ises paid by plaintiff, the sum of 8370, with
interest thereon at the rate of ten per cent
per annum from the first day of June, 1S87,
and plaintiff prays for a decree that the de
fendants be required to pay the same, or that
said premises may be sold to satisfy said
amount with interest and costs of suit. You

On September 23. 1893. tnere was tiled in ihe
office of the County Judge of said county an
instrument purporting to be the last will and
testament of John D. Gerver, deceased, also
the petition of Joshua Gerver praying that
said will be admitted to probate, and that the
said Joshua Gerver be appointed executor of
the same.
Ordered, that. October20,1893, at one o’clock
p. in., is assigned for said hearing, when all
persons interested in said matter may appear
at a county court to be held in said county
and show cause—if any exist—why 6hid will
should not be admitted to probate as the last
will and testament of said John D. Gerver,
deceased, and wThy the said Joshua Gerver
should not be appointed executor of the same.
And that notice of the pendency of said order
and the bearing thereof be given to all persons
interested in said matter by publishing a copy
of this order in the McCook Tribune, a week
ly newspaper printed in said county, for three
successive weeks prior to said day of hearing.
