Ordinance No. 45. An ordinance providing for the supply of water to the tity »f McCook, in the County of Ked Wil low, and State of Nebraska, and ita Inhabit ants, and au;homing the Lincoln Land Com pany to maintain Its system of waier works as now constructed, and establishing a tariff of reasonable water rotes, and requiring said company to erect and maintain a stand pipe, and put in nine additional tire hydrants and one watering trough, and to extend their water miiins along Dennison street in and through West McCook, and prescribing rules and regu lations for the consumption of said water de rived from said water works, and providing a pennlty for the violation of the same, and authorizing the Mayor and Council of said city to enter into a contract with said Lincoln Land Company, Its successors or assigns, for the improvement, maintainence and operation of said water water worKs, in said city, and to repeal Ordinance No, 31, and all ordinances and parts of ordinances in conflict herewith. Be it ordained by the .Mayor and Council of the City of McCook • Section 1. That in consideration of the bene fits which will result to the Cliy of McCook and lis inhabitants from the erection, maintainence and operaiion of water works in said city, there is hereby granted to the Lincoln Land Company, its successors und assigns, the right to maintain, im prove and operate the system of water works it now has in said city, and to add to the same, and to construct other works and buildings necessary to a successful operation of said works; and also the right to maintain and to lay mains, pipes, con duits and erect hydrants in and along the streets, lanjs, uvenues and alleys and public grounds of the said City of McCook, for supplying water lor fire, domestic and other purpost-s, lor the term of twenty years, and the common council of said city is hereby empowered on behalf of ilie city, to enter into contracts with said Lincoln Land Company for the construction , maintainence and operation of a system of water worksin accoidance witn the provisions and requirements of this ordi nance. SKCTioN 2. The Lincoln Land Company shall at all times after the erect ion of the stand pipe hereinulter mention! d, lurnLli all water necessury for tire protection , domestic and lawn and street sprinkling pm poses from wells ami not river water at the rates und under the conditions here inafter mentioned and in consideration of the benefits that will result to the said City of Mc Cook by the election und maintenance of said wider works the said city agrees to rent .and does rent for the term of twenty years, thirty double dischuige , ami-freezing fire hydrants , two water ing troughs and one street sprinkler. Twenty one of said hydrants and one watering trough are now located on tiie mains of said water works of said city . and nine hydrants and one watering trougli to be located at such points as the city council may direct on the mains us now laid and to be laid in said city. For such hydrants und wat ering I rough the said City of McCook agrees, after tno erection ol said stand pipe to pay the unnual rental of fitly dollars . payable quarterly , on the first day of .January, the first day of April, the first day of July and the first day of October of each >ear of said term, w.th legal rate of interest un deferred payments. The hydrants when erect ed shall be used exclusively lor.the extinction of fire and necessary practice of fire companies ; but in all cases of tire practice there shall be no nozzle used larger than one inch nor more than two hy drants used at one time nor discharged from an orfice larger than one and one. half ii.cli', and in all eases of practice the superintend-, ni of said company shall be notified Section 3. The said Lincoln Land Company, its successors or assigns , shall by December first, 1*1)3 , extend the mains of said water works from McDowell street in said city west on Dennison street to the corporate limits and from Dennison street south on Maryland uvenue to the right away of the railway company and north of Den nison street on said avenue lot) feet, and from Dt-n nison .street south Michigan ave to the right away of the railway company and north of Dennison street on said avenue 150 feet, and such ex tension will have sufficient pressure to thiow water one huudred feet from the end of the nozzle when six huudred feet of hose is used with one inch ring nozzle, with one line of hose; in considera tion of said extension and the building of said stand pipe, the city agrees to the rental of the nine additiunal hydrants and one watering trough provided lor in section two of this ordinance. The said company shall extend the mains of said water works to any pint of the city when required by resolutions of the city council and when such last extens.on shall be required there shall be erected for the use of said city one tire hydrant or watering trough for each four hundred feet of mains to be located at points in said city designated by the city council , and for each of such hydrants the city shall pay to the said company the sum of fifty dollars annually , payable quarterly as,aforesaid. Section 4. Where two or more dwellings, rooms or buildings are constructed on one lot or adjoining buildings owned or occupied by the same person or persons all such buildings, rooms or d welling* shall be included at the regular rates in the collection of water rent Section 6. Water used or to be used for pur poses not sped Bed or rate given in the loregoing schedule the rate may be established by the su perintendent of the water works and remain in force until altered or changed by the Mav or and City Council of the City of McCook . Nebraska. Section 7. Application for service attachments or water must be made by the owner or agent of the property in writing or blanks furnished at tlis office of the superintendent of the waterworks; and must state fully and truly all purposes for which it is required; and it Is hereby declared un lawful to make any fraudulent representations as to the purposes for which water is required ; said blanks to be submitted to and approved by the City Council. Bkction 8, Consumers must keep their own service pipes and attachments in order and from freezing, and will also keep in good repair and ac cessible at nil times to the plumber a stop cock four feef under ground and as near to the outer edge of the pavement as practicable and protected with substaniial iron case covered with a t.ght tit ting iron lid. Section !>. No deduction in rates shall be re quired for time any service pipe is frozen or out of use for any cause. Section lo. Water running to waste or to keep pipes from freezing is prohibited under penalty of having water shut off wilh or without notice. Section 11. Sprinkling permits shall be grant ed for the lawn sprinkling season only on the pay ment of rate aforesaid to the said company except as herein otherwise provided. Said lawn sprink ling season shall begin with the fifteenth day of April ahd shall end with the fifteenth day of Octo ber in each year, provided the permit is taken out after the first of any quarter, in suqb case pay ment shall be made dating from the first of the quarter in which the permit was taken out. Under lawn sprinkling permits the use of water is limited to such seasons for sprinkling only and the use of hand hose with no larger than three-sixteenth noz zle, is limited to the hours of from six a, m. to eight o’clock a. m. and from seven o’clock p. m. to nine o’clock p. ni, central time, each day duiing the lawn sprinkling season. The use of hand hose without nozzle as a substitute for a fountain or al lowing it to run while not held by hand is forbid den. Any use of a sprinkling attachment or de vice using water in excess of the amount that would pass through a three-sixteenths inch nozzle is a violation of the terms o( the permit. SECTroN 12, Lawn and fountain permits shall be considered a luxury and may be limited to less hours in case of shortage or from any other cause it may seem to be impossible to supply water to all persons but a proportionate deduction from the price of service shall be made from the time water is not furnished; in all cases domestic use shall take precedence over lawns and fountains. Section 13. Water rates except lawn and foun tain tax. shall be paid quarterly in advance on the first day of January, April, July and October; lawn and fountain tax to be paid according to contract, and unless taxes are paid within fifteen days nfler the same become due ten percent, shall be added thereto for the expense of collecting the same. Section 14. The superintendent of the said water works or any other proper officer of the company shall have access, at all reasonable hours , to all parts of the premises to which water is supplied to make necessary examinations and all refusals on the part of the consumer of such access shall be deemed sufficient cause to turn off the water, Section 15. The Lincoln Land Company is hereby required to erect and maintain at an eleva tion as great as their water tank In the park in the City of McCook, a stand pipe for said water works, which stand pipe shall not be less than twenty feet in diameter and ct least eighty-five feet high, and shall be of three-fourths inch steel, an.t shall he erected and ready for use bv December first, 1893. Section 1C. It shall be unlawfo1 for any plumber or plumbers or pipe titter to do any work upon anv of the pipes of tlie system of waterworks owned bv the Lincoln Land Com pany until such plumber or plumbers or pipe fit ters have first procured a license to do so from the City Council of McCook, and give a bond in the sum of one thousand dollars, and shall im mediately report to the superintendent of water works aiiy work performed upon said water works. The franchise given to said Lincoln Land Company by section one of Ibis ordinance.is granted upon tile condition that the company comply substantially with requtre mentsof this ordinance, In reference to tile building of the stand pipe and the laying of water mains in West McCoo'-, as required I>y section 3 of this ordinance, and the faiitti" of said Company to make said improvements within the lime limited by this ordinance, shall work a forfeiture of said franchise. section 18. It shall be unlawful for any one to tap the mains of said Compamy, with any other than lead pipe ; provided, however, that such lead pipe need not. extend further than the curb line of the street, and all other pipe used mav be of galvanized iron or lead at the option of the party putting in file same. Section 19 It shall be unlawful f u- any tier son unauthorized bv the City of McCook or the superintendent of the water works, to take water from any public nr private hydrant, plug, street washer, from cock ; hose ; pipe or foun tain ; except for fire purposes and for the use of the tire department in case of fire ; or in any way tako or use any water for private use with out first paying for same and receiving a receipt therefor. section 20. It shall be unlawful for any per son to remove . obstruct or in any way injure any fire hydrant; valve ; valve box; or stop cover or in any manner injure any building; machinery ; or carry off any pipe ; apparatus ; tools or fixtures of the waterworks or fire de part nient. section 21. The Lincoln l and Company is hereby authorized to make such usual and ordinary rales and regulations, not inconsistent with litis ordinance, as may he necessary to the proper and convenient use and operation of its water works in Die City of McCook. Section22. Violations of seclions seven; eight; ten ; eleven : thirteen ; fourteen and twenty of this ordinance, by the consumer, shall operate to terminate the contract between the consumer and the Lincoln Land Company.! and forfeit all money paid thereon; and the said company snail have the light to turn off ihe supply of water and recover damages , and in addition thereto the Lincoln Land Company may exact a penalty of one dollar before rai n ing on the water; and the turning off of water by an agent of the said Lincoln Land Company shall be prima facie evideuce of a violation of the sections of this ordinance. Section 23. When water lias been turned off for any cause the plumper may collect one dollar for turning water on. If the ferule for corporation cock has been withdrawn on ac count ot the consumer refusing to take water or by his consent an extra charge of four dollars may be made by the company for replacing the sa • e. Section 24. Any person or persons who shall unlawfully and intentionally violate any of the provisions of this ordinance except as to the payment of water rates and for foi lures shad upon conviction thereof in addition to the for feitures liabilities stipulations and reservations therein coutainod pay a fine of not less than one dollar and not more than twenty-five dol lars and shall stand committed to jail until sucli fine and costs are paid. section 25. Any person or persons who sliali on behalf r,f themselves or any other per sons or associations partnerships or corporations collect exact receive or charge any greater amount than is by this ordinance allowed to be charged or received from any consigner for water used as specified in this ordinance or shall refuse to furnish water to any consumer who applies for the same and lenders t‘>e amount established by this ordinance such per son or persons upon conviction thereof shall be fined in any sum not less thad five riollais and not more than twetny-five d- liars for each offence and shall he committed to jail until such fine and costs are paid. Section 20. Ordinance No. thirty-one and all ordinances and parts of ordinances hereto, foie enacted that conflict with any of the pro visions of this ordinance are hereby repealed. Section 27.
