Greenwalt Retain. HII Office. On the convening of the new county board Tuesday , Geo. Greenwalt , the old member was nllowed to retain his scat as' a hold over. Mr. Roy Welch the supervisor elect , was present to claim his rights , but the old board was three to two against 'him politically , a contest was useless. Mr. Greenwalt had filed a hold over bond and Mr.Velch had filed his bond , 'both of which were approved. The cause of the contention is the uncertainty of the new law passed last winter. It provided for extending the term of Supervisors - visors and Register of Deeds one year. 8upreme Court Commissioner - sioner Letton , to whom the question - tion was relerred' held the law was legal , but when his opinion was submitted to the judges of the Supreme Court , Chief Justice Holcomb and Judge Barnes toole , a different view , the Chief Justice - tice handing down the decision I that the law was not coustitu- , ' tional , Judge Sedwick cHssenttng. ince then Judge Letton has been elected Justice of the Sue preme Court to succeed Judge Holcomb , whose time expired the first of the year. The holdover officers see a possible chance with the chimge of tbe personal of the court to get a favorable decidiop and steps bave been taken to have the case reviewed by the supreme court with the hopes of having Judge Holcombs decisi n reversed. The ituation is the same witb C , O. Lind , tbe outgoing regis- tcr of deeds and Jobn T. Wood , register of deeds elect. We understand an agreement Wf..S entered into between the contending - tending parties in both instances that should the fonner opinion of the supreme court be sustained the old officers will quietly va- cate. Should the former decision be reversed the election of register of deeds and supervisors will be void and the old officers will hold until 1907. This will require the election of a register of deeds this fall and an entire new board of supervisors. The terms of G. H. Thorpe , H. B. Schneringer , J. T. Arthur , and B. P. Morris will expire Jnn. 1 , 1907 , by limitation. The terms of A. Fonda , Joe Fennimore , who were reelected last fall for two years , will only hold over , by tbe terms of the new law , for the year , their elec. tion being void : Geo. Green. walt , although defented for re. election will bold over for the t year only. Thus it will be secn that sbould the new law be held good that by the terms of limita. . tion and legi lntion tbere will be , seven supervisors t.9 .elect this ? faU , register of deeds and county 'r . attorney besides the state officers. , ( !
