It W l ! ; about the middle of the afternoon 'l'hursday , white the jury was. . njoying a ten minutes iutermis- sion , that Judge Grimes propos- cd to Attorney Sullivan , one of the attorneys for the church , that he would pay half the amount sued for if hc would pay the other half. Sullivan accepted - ed and the amount , : : ; 27.00 , was paid into court. On the re- asscm hli ng of the jury Judge Grimcs dismissell the case. lIe delivercd the following speech : I'Gcntlemen of the jury , the amount involved in this case has heen paid into court , and you are discharged from further consideration - sideration of it. It is a shame and an outragc that a case of this kind should bc pending in this court. Inmy judgment , this lawsuit docs thc Christian religion - ion of this community and the community from which these parties come more injury than all the preachers will be able to o\'ercome in th next five years. It so appeals to the court's mind and it so appeals to some of the counsel that they have seen fit to tale this course. 'l'he amount in'oh'ed , twenty-seven doll an , has beel' ' paid into court , and the court will entcr up a judgement for plaintiff for that amount ; the court has assumed the burden of making an ordcr that each party pay their own costs and thc case is dismissed. " 'l'he action of the Judgc mct thc gcneral approval of thc audience - ence as thc fairest way out of an unpleasant affair. But it can hardly be held as legal justice. If thc Young Peoplcs Society were in the right , it is hardly fair that it should hc comp lled to bear thc expense of a long drawn out suit forced upon them b ) ' their seniors. 'l'hc indictmcnt alleges that Senator Dietrich accepted money and property in consideration of his recommending Fisher for ap- pointmcnt as postmaster. ' 1'he charge against Fisher is that he mad an agreement with Senator Dietrich by which he was to pay the latter in property and money 81,300 for securing the tlppoint- ment as postmaster. 'l'he llIl ctmcnts secms , from reports , to havc been secured through the efforts of ex-Post- master f4epold Hahn and District Attorney Summers. As both of thcsc gcntlemen have personal greivences against the Senator , the public will do well to withhold - hold judgement in the matter until - til further de\'elopements. 'rhc Omaha Bec of the 17th. gives the following history of the case , I which may throw 50ml' light enl l the subject : " 'rhe postofiice at Hastings up to two years ago was located in a building crectcd by the local post of the Grand Army of the R- public. Previous to installation in this building it had been in . other quarters and successive . postma5ters had furnished thc postofiicc fixtures themselves. 'rhe Grand Army of the Republic , bought the fixtures for S50C . and their use was includcd in the . government lease. About three l years ago considerable effort was . made to secure better quarters for , the postofiice business and the contention became enc between opposite ends of town. Senator Dietrich , who had then just beel1 . elected governor , had put up a new building near the Gram1 Army of the Republic building and , anticipating removal of the postoffice , took the matter u [ with the postoffice authoritie ! during his visit to 'Vashingtor. ) to attend the inauguration oj . Presidcnt McKinley. A leas ( was agreed upon subject to mon specific terms , but the negotiations - tions dragged on until afte ] Governor Dietrich had been elected - ed United States senator. There have also been several stories about the alleged payment of money b ) ' successf l applicants for' postol1 ce appomtments at Alma and Orleans in I-Iarlan county , but nothing to connect the senator with the alleged ! transacl1ons.
